Alabama ESA Laws at a Glance

Last reviewed November 2026 against official Alabama and federal sources.

Alabama’s 2018 Assistance and Service Animal Integrity in Housing Act works alongside the federal Fair Housing Act. It doesn’t create new rights, but it sets clear rules for documentation and for misuse.

Housing law

Ala. Code § 24-8A-1 et seq.

An ESA counts as an assistance animal when it qualifies as a reasonable accommodation under the Fair Housing Act.

ESA letter rules

Ala. Code § 24-8A-3

Only when the need isn’t apparent; must come from your medical provider; landlord must keep it confidential.

Fake ESA penalty

§§ 24-8A-4, 24-8A-5

$500 civil penalty or Class C misdemeanor; repeat offenses are Class B misdemeanors.

Where to file a complaint

U.S. Department of Housing and Urban Development (HUD)

Alabama has no active state complaint office. File with HUD within 1 year.

Your medical provider, not a website: Alabama defines reliable documentation as documentation from a medical provider of the person who needs the accommodation. A certificate or registration bought online does not meet that standard.

2026 federal change: since May 22, 2026, HUD presumes accommodation requests reasonable only for individually trained animals and reviews untrained ESAs case by case. With no state complaint office in Alabama, clear documentation from your provider matters even more.

Where an Alabama ESA Letter Helps — and Where It Doesn’t

Apartments & Rentals

Yes. Use it to ask an Alabama landlord or property manager for an exception to a no-animals policy.

College Housing

Usually. The University of Alabama, Auburn, UAB and other campuses review ESA requests through disability or housing services.

Flights

No. Airlines at BHM, HSV, MOB and MGM may treat an ESA as a pet, with normal pet fees and carrier rules.

Stores & Restaurants

No. Only trained service animals have public-access rights under the ADA and Ala. Code § 21-7-4.

What Alabama Treats as ESA Fraud in Housing

Under Ala. Code §§ 24-8A-4 and 24-8A-5, it is an offense to intentionally:

  • Claim you or someone else has a disability-related need for an assistance animal when you don’t
  • Make materially false statements to get ESA documentation
  • Create or hand over documentation falsely saying an animal is an assistance animal
  • Put a harness, collar, vest or sign on an animal that isn’t an assistance animal

Who may qualify: people with a mental or emotional impairment, such as anxiety, depression or PTSD, that substantially limits one or more major life activities, when the animal genuinely helps with it. A diagnosis alone doesn’t qualify someone.

An honest evaluation protects you: a letter from your own licensed provider is the documentation Alabama law recognizes.

Alabama ESA Letter FAQ

Does Alabama have its own ESA law?

Yes. The Alabama Assistance and Service Animal Integrity in Housing Act (Ala. Code §§ 24-8A-1 to 24-8A-5, Act 2018-235) covers emotional support animals in rental housing. It defines when an ESA counts as an assistance animal, what documentation a landlord may ask for, and the penalties for misrepresentation.

Who can write an ESA letter in Alabama?

Alabama law says "reliable documentation" only includes documentation from a medical provider of the person who needs the accommodation. In practice, that means a licensed provider who has evaluated you and treats you, such as a psychologist, licensed professional counselor, licensed clinical social worker, psychiatrist or physician. A provider caring for someone in Alabama generally needs to be licensed to practice there.

When can an Alabama landlord ask for documentation?

Only when your disability, or your disability-related need for the animal, is not readily apparent or already known to the landlord. If both are obvious, the landlord may not demand documentation.

Does an Alabama landlord have to keep my ESA letter private?

Yes. Ala. Code § 24-8A-3 requires landlords to keep all documentation they receive confidential, in line with the federal Fair Housing Act and the Rehabilitation Act.

Can an Alabama landlord refuse my emotional support animal?

A landlord must consider your request as a reasonable accommodation under the federal Fair Housing Act, and Alabama law counts an ESA as an assistance animal only when it qualifies as one. Since May 22, 2026, HUD presumes these requests reasonable only for individually trained animals and reviews untrained ESAs case by case, so good documentation from your provider matters. A request can also be denied if the animal poses a direct threat or would cause substantial damage.

Can an Alabama landlord charge a pet fee for an ESA?

Alabama law has no ESA-specific rule on pet fees. If your accommodation request is granted, ask in writing whether pet deposits, pet rent and breed or weight limits will be waived. You remain responsible for any damage your animal causes.

Is it illegal to fake an emotional support animal in Alabama?

Yes. It is an offense to falsely claim a disability-related need for an assistance animal, to lie to obtain ESA documentation, to create or give someone false documentation, or to put a vest, collar or sign on an animal that is not an assistance animal. A first offense carries a $500 civil penalty or a Class C misdemeanor; later offenses are Class B misdemeanors.

Do online ESA registrations work in Alabama?

Not as documentation. Because Alabama limits reliable documentation to your medical provider, a registration, ID card, vest or certificate on its own does not meet the law. Putting assistance-animal gear on an animal that does not qualify is itself an offense in Alabama housing.

Can I take my ESA into stores or restaurants in Alabama?

No. Public-access rights under the ADA and Ala. Code § 21-7-4 belong to trained service animals. Alabama businesses may apply their own pet policies to emotional support animals.

Can I fly with my ESA from Birmingham or Huntsville?

Under the U.S. Department of Transportation's rules (14 CFR Part 382), airlines may treat emotional support animals as pets, so expect pet fees, carrier size limits and cabin caps. Check your airline's pet policy before booking. A trained psychiatric service dog is still accepted as a service animal.

Where do I file a housing complaint in Alabama?

Alabama has no active state agency taking fair housing complaints, so file with HUD within one year of the incident. A private Fair Housing Act lawsuit can be filed within two years, and local fair housing centers in Birmingham, Mobile and Montgomery can help.

Does getting an evaluation guarantee an ESA letter?

No. The licensed provider decides, based on your individual evaluation, whether an ESA recommendation is appropriate. If it isn't, no letter is issued.
