ESA Letter in California, Done the Right Way
Online emotional support animal evaluations for Californians in Los Angeles, San Diego, San Jose, San Francisco, Sacramento and beyond
California has some of the strictest ESA letter rules in the country. Under AB 468, documentation for an emotional support dog must come from a licensed provider after a clinical evaluation and a client relationship of at least 30 days.
We help you start that process online, so your letter holds up when you give it to a California landlord.

Pre-screening does not guarantee approval. In California, documentation for an emotional support dog cannot be issued until at least 30 days after the client relationship begins.

California ESA Laws at a Glance
Last reviewed November 2026 against official California and federal sources.
Two sets of rules matter in California: fair housing law, which decides whether a landlord must accommodate your animal, and AB 468, which decides what a valid letter for an emotional support dog looks like.
Housing law
The Fair Employment and Housing Act bars disability discrimination in housing, including refusing reasonable accommodations.ESA letter rules
For dogs: licensed where the letter is provided, 30-day client relationship, clinical evaluation, license details on the letter.Penalties
$500 / $1,000 / $2,500 civil penalties for breaking the ESA-dog rules; faking a service dog is a misdemeanor.Where to file a complaint
File within 1 year of the incident, or with HUD within 1 year. The 30-day rule: for an emotional support dog, California does not allow documentation until a client-provider relationship has existed for at least 30 days. Any service offering an instant California ESA letter for a dog is not following state law, and a landlord can question that letter.
2026 federal change: since May 22, 2026, HUD reviews requests for untrained ESAs case by case. California’s own fair housing law still applies, which makes a properly documented, AB 468-compliant letter more important.

Where a California ESA Letter Helps — and Where It Doesn’t
Apartments & Rentals
Yes. Use it to ask a California landlord, property manager or HOA for an exception to no-pet rules under FEHA.
UC, CSU & College Housing
Usually. Campuses review ESA requests through disability or housing services. Apply early and allow for the 30-day rule.
Flights
No. Airlines at LAX, SFO, SAN, SJC and SMF may treat an ESA as a pet, with normal pet fees and carrier rules.
Stores & Restaurants
No. Only trained guide, signal and service dogs have public-access rights under the ADA and Civil Code § 54.2.
What a California ESA Letter for a Dog Must Include
Under Health & Safety Code § 122318, a provider writing documentation for an emotional support dog must:
- Hold a valid, active license in the jurisdiction where the documentation is provided
- Include the license effective date, number, jurisdiction and type
- Have a client-provider relationship with you for at least 30 days
- Complete a clinical evaluation of your need for an emotional support dog
- Tell you that falsely claiming a dog is a guide, signal or service dog is a misdemeanor
Who may qualify: people with a mental or emotional disability, such as anxiety, depression or PTSD, that substantially limits daily life, when the animal genuinely helps with it. A diagnosis alone doesn’t qualify someone.
A registration, certificate or ID card on its own is not an ESA letter, and it does not meet California’s AB 468 requirements.
California ESA Letter FAQ
Does California have its own ESA letter law?
Yes. Since January 1, 2022, California Health & Safety Code § 122318 (AB 468) sets rules for anyone who writes documentation for an emotional support dog. The provider must be licensed where the documentation is provided, have a client relationship of at least 30 days, complete a clinical evaluation, and warn you that misrepresenting a dog as a service dog is a crime.
Why does a California ESA letter take at least 30 days?
For an emotional support dog, California law does not allow the provider to issue documentation until a client-provider relationship has existed for at least 30 days. A legitimate California ESA letter for a dog therefore cannot be issued the same day as your first appointment. Be wary of any service that promises an instant California ESA letter for a dog.
Does the 30-day rule apply to cats and other animals?
The AB 468 requirements apply to documentation for emotional support dogs. Requests for other animals are still reasonable-accommodation requests under California fair housing law, and a landlord may ask for reliable documentation of your disability-related need.
Who can write an ESA letter in California?
A health care practitioner licensed in the jurisdiction where the documentation is provided, such as a licensed psychologist, licensed clinical social worker (LCSW), licensed marriage and family therapist (LMFT), licensed professional clinical counselor (LPCC), psychiatrist or physician. The letter must show the license number, type, jurisdiction and effective date.
Can a California landlord refuse my emotional support animal?
A landlord must consider your request as a reasonable accommodation under California's Fair Employment and Housing Act (FEHA) and the federal Fair Housing Act. Since May 22, 2026, HUD reviews requests for untrained ESAs case by case at the federal level, but California's own fair housing law and the Civil Rights Department still apply. A request can be denied if the animal poses a direct threat or would cause substantial damage.
Can a California landlord charge a pet deposit for an ESA?
If your accommodation request is granted, ask in writing whether pet deposits, pet rent and breed or weight limits will be waived. California also limits security deposits generally under Civil Code § 1950.5. You remain responsible for any damage your animal causes.
Is it illegal to fake an emotional support dog in California?
Yes, in several ways. Passing off a dog as a guide, signal or service dog is a misdemeanor under Penal Code § 365.7, and businesses or providers that break California's ESA-dog documentation and seller-notice rules face civil penalties of $500, $1,000 and then $2,500 under Health & Safety Code § 122319.
Can I take my ESA into stores or restaurants in California?
No. Public-access rights under the ADA and California Civil Code § 54.2 belong to trained guide, signal and service dogs. Businesses may apply their own pet policies to emotional support animals.
Can I fly with my ESA from LAX, SFO or San Diego?
Under the U.S. Department of Transportation's rules (14 CFR Part 382), airlines may treat emotional support animals as pets, so expect pet fees, carrier size limits and cabin caps. Check your airline's pet policy before booking. A trained psychiatric service dog is still accepted as a service animal.
Do UC and CSU dorms allow ESAs?
University housing is covered by fair housing law, and schools that receive federal funding must also follow Section 504 of the Rehabilitation Act. UC, CSU and private campuses review ESA requests through disability or housing services, so start early, and allow for the 30-day rule if your ESA is a dog.
Where do I file a housing complaint in California?
With the California Civil Rights Department within one year of the incident, or with HUD within one year. A private Fair Housing Act lawsuit can be filed within two years.
Does getting an evaluation guarantee an ESA letter?
No. The licensed provider decides, based on your individual evaluation, whether an ESA recommendation is appropriate. If it isn't, no letter is issued.
