ESA Letter in Hawaii From a Treating Professional
Emotional support animal evaluations for O‘ahu, Maui, the Big Island, Kaua‘i and every island in between
Hawaii’s housing law names emotional support in its definition of an assistance animal, and it spells out what verification a landlord may request: a letter from a treating health care professional, mental health professional or social worker, not a vest or an online registration.

Hawaii ESA Laws at a Glance

Few states are as specific as Hawaii. HRS § 515-3 covers emotional support animals by name, limits what landlords can ask, and rejects online “registrations” as proof.
Who’s covered
“Assistance animal” includes trained or untrained animals of any species that provide emotional support for a disability.ESA letter rules

Vests, tags, online registrations

Within 1 year (extended by Act 56 of 2026), or HUD within 1 year.Moving to Hawaii with an ESA? The state’s quarantine exemption is for guide and service dogs only. The Department of Agriculture says emotional support isn’t “work or tasks,” so an ESA must meet the regular rabies-quarantine rules. Start the paperwork months before you fly.
2026 federal change: since May 22, 2026, HUD reviews untrained ESAs case by case. Hawaii’s statute expressly includes untrained emotional support animals, and the HCRC enforces it.

Where a Hawaii ESA Letter Helps — and Where It Doesn’t
Rentals, Condos & Base Housing
Yes. Use it with landlords, condo associations (AOAOs) and military housing on O‘ahu and beyond.
UH & Campus Housing
Usually. UH Mānoa, UH Hilo and private colleges review ESA requests through disability services.
Flights & Arrival
No. Airlines may treat an ESA as a pet, and ESAs arriving in Hawaii follow pet quarantine rules.
Stores & Beaches
No. HRS § 347-13 and the ADA cover service animals, not ESAs.
What a Hawaii Landlord Can’t Ask For
Under HRS § 515-3(a)(9), when verifying your disability or your need for an assistance animal, a housing provider may not request:
- Your medical records
- Access to your health care providers
- Your diagnosis
- The nature or severity of your disability
Who may qualify: people with a physical or mental impairment that substantially limits a major life activity, when the animal alleviates one or more identified symptoms. Anxiety, depression and PTSD are common reasons people seek an evaluation.
In Hawaii, a vest, tag or online certificate is specifically not valid verification.
Hawaii ESA Letter FAQ
Does Hawaii law protect emotional support animals?
Yes, explicitly. HRS § 515-3(b) defines an "assistance animal" to include an animal that provides emotional support that alleviates one or more identified symptoms or effects of a person's disability, whether or not it is trained and whether or not it is a dog. Refusing a reasonable accommodation for one can be a discriminatory practice under § 515-3(a)(9).
Who can write an ESA letter in Hawaii?
Hawaii's statute says verification may come from a letter or other communication from a treating health care professional, mental health professional or social worker. A provider caring for someone in Hawaii generally must hold a Hawaii license.
What can a Hawaii landlord ask for?
If your disability isn't apparent, information verifying it; if the need for the animal isn't apparent, verification that the animal alleviates a symptom of your disability. The landlord may not ask for medical records, access to your providers, or your diagnosis or the nature or severity of your disability.
Do vests or online ESA registrations count in Hawaii?
No. HRS § 515-3(a)(9) says a vest, other distinguishing garment, tag, or registration documents commonly bought online do not constitute valid verification. A letter from a treating professional is what the law contemplates.
Can a Hawaii landlord or condo association restrict my ESA?
Hawaii allows reasonable restrictions on an assistance animal granted as an accommodation, for example rules on leashing in common areas or waste cleanup. Condo associations (AOAOs) that enforce pet rules are generally covered by fair housing law too. Since HUD's May 22, 2026 policy change, untrained ESAs are reviewed case by case federally, but Hawaii's statute expressly includes them.
Can a Hawaii landlord charge a pet fee for an ESA?
HRS § 515-3 doesn't address pet fees or deposits for assistance animals. Ask your landlord or association to confirm in writing whether pet fees and deposits will be waived, and remember you are responsible for damage your animal causes.
Can I bring my ESA with me when I move to Hawaii?
Yes, but plan months ahead. The Hawaii Department of Agriculture's no-quarantine pathway is for guide and service dogs, and it states that emotional support does not count as work or tasks. An ESA dog or cat entering Hawaii must meet the regular rabies-quarantine requirements, such as the 5-Day-or-Less program, which involve rabies vaccinations, a blood test and waiting periods.
Is it illegal to fake an emotional support animal in Hawaii?
Hawaii has no ESA-specific misrepresentation penalty. Its fine for misrepresenting a service animal (HRS § 347-2.6) covers public places. False statements in a housing request can still be denied and may violate your lease.
Can I take my ESA into stores, restaurants or beaches in Hawaii?
No. HRS § 347-13 and the ADA give public-access rights to service animals, not ESAs. Many Hawaii beaches and parks also have their own animal rules.
Can I fly between the islands with my ESA?
Under 14 CFR Part 382, airlines may treat an ESA as a pet on flights from HNL, OGG, KOA, LIH and ITO, so check interisland pet rules and fees. Neighbor-island arrivals from the mainland may need a separate inspection permit. A task-trained psychiatric service dog still flies as a service animal.
Where do I file a housing complaint in Hawaii?
With the Hawaii Civil Rights Commission within one year of the incident; Act 56 (2026) extended the HCRC deadline to one year. You can also file with HUD within one year or bring a private Fair Housing Act lawsuit within two years.
Does an evaluation guarantee an ESA letter?
No. The provider evaluates you and writes a letter only if, in their professional judgment, an ESA is appropriate.
