ESA Letter in Idaho From a Licensed Provider

Online emotional support animal evaluations for Boise, Meridian, Nampa, Idaho Falls, Pocatello, Coeur d’Alene and Twin Falls

Idaho’s own housing statute doesn’t spell out ESA rights, so most Idaho ESA requests rely on the federal Fair Housing Act. That makes a clear, honest ESA letter from a licensed provider the most important part of your request.

Idaho ESA Laws at a Glance

Last reviewed November 2026 against official Idaho and federal sources.

Idaho protects renters with disabilities under the Idaho Human Rights Act, but its housing section is narrower than federal law. Here’s how the pieces fit.

State housing law

Idaho Code § 67-5909(8)

Bars disability discrimination in housing and covers reasonable modifications to premises; it doesn’t address rule accommodations.

Where ESA rights come from

Federal Fair Housing Act

Requires reasonable accommodations in rules, such as waiving no-pet policies, for covered housing.

Misuse law

Idaho Code § 18-5811A

Misdemeanor to falsely use an assistance animal to gain disability benefits. It doesn’t mention housing or ESAs.

Where to file a complaint

Idaho Human Rights Commission

Within 1 year (§ 67-5907(1)), or with HUD within 1 year.

Why the federal law matters most in Idaho: Idaho’s statute talks about letting tenants modify a unit, like installing a ramp. The duty to bend rules, like a no-pets policy, comes from the federal Fair Housing Act, so frame an ESA request and any complaint around it.

2026 federal change: since May 22, 2026, HUD presumes accommodation requests reasonable only for individually trained animals and reviews untrained ESAs case by case. Without a broader state rule to fall back on, Idaho renters benefit most from thorough documentation.

Where an Idaho ESA Letter Helps — and Where It Doesn’t

Rentals & Base Housing

Yes. Use it with landlords and property managers covered by the Fair Housing Act, and with Mountain Home AFB housing.

Boise State & U of I Housing

Usually. Idaho campuses handle ESA requests through disability or accessibility services.

Flights

No. At BOI, IDA and SUN, airlines can treat an ESA as a pet under their own rules.

Stores & Restaurants

No. Idaho Code §§ 56-703 and 56-704 cover service dogs, not ESAs.

Who May Qualify for an Idaho ESA Letter?

Under fair housing law you need a disability, a mental or emotional impairment that substantially limits a major life activity, and a real need for the animal because of it. Idahoans often seek an evaluation for:

  • Anxiety and panic attacks
  • Depression, including during long, isolating winters
  • PTSD, including for veterans
  • Other conditions that disrupt sleep, work or relationships

A strong Idaho ESA letter is dated and signed by a licensed provider, shows their license type, number and state, and confirms a disability-related need for the animal. It doesn’t need to name your diagnosis.

Registrations, vests and ID cards don’t replace a provider’s letter.

Idaho ESA Letter FAQ

Does Idaho have an emotional support animal law?

No. Idaho has no ESA-specific statute, and the housing section of the Idaho Human Rights Act (Idaho Code § 67-5909(8)) addresses reasonable modifications to premises rather than accommodations in rules such as no-pet policies. In practice, ESA requests in Idaho rest mainly on the federal Fair Housing Act, which requires reasonable accommodations in rules, policies, practices and services.

Does Idaho law still protect tenants with disabilities?

Yes. The Idaho Human Rights Act prohibits discrimination in renting, leasing, buying, selling and financing housing because of disability, and the Idaho Human Rights Commission investigates housing complaints.

Who can write an ESA letter in Idaho?

A licensed provider who has evaluated you, such as an Idaho-licensed psychologist, licensed professional counselor, licensed clinical social worker, psychiatrist, nurse practitioner or physician. Idaho sets no ESA-letter format, but providers treating someone in Idaho generally must hold an Idaho license.

Can an Idaho landlord refuse my emotional support animal?

A landlord covered by the federal Fair Housing Act must consider your ESA as a reasonable-accommodation request and may refuse it if the animal is a direct threat or would cause substantial damage, or if the need isn't supported. Since HUD's May 22, 2026 policy change, untrained ESAs are reviewed case by case, so a clear letter from a provider who knows you matters even more in Idaho.

Can an Idaho landlord charge pet rent or a deposit for an ESA?

Idaho has no statute on ESA fees. Ask your landlord in writing whether pet rent, deposits and breed or weight limits will be waived if your accommodation is approved. Any damage your animal causes is your responsibility.

Is it a crime to fake an ESA in Idaho?

Idaho has no ESA-specific penalty. Idaho Code § 18-5811A makes it a misdemeanor for someone without a disability to use an assistance animal to try to gain treatment or benefits meant for people with disabilities, but it doesn't mention housing or ESAs specifically. A false housing request can also be denied and may breach your lease.

Can I take my ESA into stores or restaurants in Idaho?

No. Idaho Code §§ 56-703 and 56-704 and the ADA protect service dogs in public places, not emotional support animals.

Can I fly with my ESA from Boise?

Under 14 CFR Part 382, airlines at Boise (BOI), Idaho Falls (IDA) and Sun Valley (SUN), and at Spokane for North Idaho, may treat an ESA as a pet. Check fees and carrier rules first. A task-trained psychiatric service dog still flies as a service animal.

What about housing at Mountain Home Air Force Base?

Base and privatized military housing set their own animal policies. Ask the installation housing office early and include your provider's letter with your request.

Where do I file a housing complaint in Idaho?

With the Idaho Human Rights Commission within one year of the incident (Idaho Code § 67-5907(1)), or with HUD within one year. Because Idaho's statute is narrower on accommodations, many ESA complaints are best framed under the federal Fair Housing Act. A private federal lawsuit can be filed within two years.

Does an evaluation guarantee an ESA letter?

No. You're paying for an honest assessment. The provider writes a letter only if they decide an ESA is appropriate for you.
