Kentucky ESA Laws at a Glance

One statute does most of the work in Kentucky. KRS 383.085, in the landlord-tenant chapter, defines assistance animals to include animals that provide emotional support, and it applies alongside the Kentucky Civil Rights Act and the federal Fair Housing Act.
Housing & fees
Landlords evaluate requests, may verify documents, and can’t charge pet fees, deposits or added rent.Who may document
LCSW, counselor, APRN, psychologist or physician with an unrestricted Kentucky license and active Kentucky practice.Misrepresentation
False claims, fake documents, fake vests and fee-driven letters: a violation, fine up to $1,000.Where to file a complaint
Within 1 year; complaints must be signed and notarized. Or with HUD within 1 year.Kentucky’s provider rule is strict: documentation must come from someone giving you good-faith care, not a business whose main service is selling letters. Long-time Kentucky residents need a provider with an unrestricted Kentucky license who actively practices here; people who just moved may use an ongoing provider from their former state.
2026 federal change: since May 22, 2026, HUD has reviewed untrained ESAs case by case. The Fair Housing Act’s text is unchanged, and KRS 383.085 still names emotional support animals, so a letter that meets Kentucky’s standard is your strongest footing.

Before You Hand Over a Kentucky ESA Letter
Kentucky landlords can check documentation, so make sure yours holds up:
- It comes from an LCSW, professional counselor, APRN, psychologist or physician
- The provider’s Kentucky license is valid, unrestricted and listed on the letter
- The provider actively practices in Kentucky (or is your ongoing provider from your previous state)
- It reflects a real therapeutic relationship, not a letter-only purchase
- It confirms a disability and a disability-related need without naming the diagnosis
- Your animal wears no vest or sign calling it a service animal
Who may qualify: Kentuckians with a mental or emotional disability, such as anxiety, depression, PTSD or bipolar disorder, when an animal relieves identified symptoms.
For landlords: KRS 383.085(5) says a landlord isn’t liable for injuries caused by an assistance animal allowed as a reasonable accommodation under federal or other applicable law.
Kentucky ESA Letter FAQ
Does Kentucky have an emotional support animal law?
Yes. KRS 383.085, created in 2018 and amended in 2019, covers assistance animals in housing. It expressly includes emotional support animals, says what documentation a landlord may ask for, bars pet fees for approved animals, and makes misrepresenting an assistance animal a violation with a fine of up to $1,000.
Who can write an ESA letter in Kentucky?
KRS 383.085 accepts documentation from a provider in a good-faith therapeutic relationship: a licensed clinical social worker, professional counselor, advanced practice registered nurse, psychologist or physician who holds a valid, unrestricted Kentucky license and maintains an active practice in Kentucky.
Can a provider who just sells ESA letters qualify in Kentucky?
No. The statute excludes providers whose primary service is selling accommodation documentation for a fee, and it makes providing documentation primarily to obtain a fee part of the misrepresentation offense. A Kentucky evaluation should be genuine clinical care.
I just moved to Kentucky. Can I use my old provider?
Possibly. If you moved from another state, KRS 383.085 accepts documentation from a provider licensed in your former state, as long as the therapeutic relationship is ongoing.
Does Kentucky allow ESA evaluations by telehealth?
KRS 383.085 does not mention telehealth either way. What it requires is the provider: Kentucky-licensed without restrictions, actively practicing in Kentucky, and in a good-faith therapeutic relationship with you. Ask before you book whether your provider meets each of those points.
Can a Kentucky landlord charge pet rent or a deposit for my ESA?
No. Under KRS 383.085(4) a tenant granted an assistance animal accommodation cannot be required to pay a pet fee, pet deposit or additional rent. You are responsible for physical damage the animal causes if resident pet owners generally are, and you must follow the lease rules that apply to everyone.
Can a Kentucky landlord verify my ESA letter?
Yes. If your disability or need isn't obvious, the landlord may request reliable documentation and may independently verify that it is authentic. Since HUD's May 22, 2026 policy change, untrained ESAs are also reviewed case by case under federal law, so expect the landlord to read the letter closely.
Is it illegal to put a service vest on an ESA in Kentucky?
It can be. KRS 383.085(6) makes it an offense to knowingly fit an animal that isn't an assistance animal with a harness, collar, vest or sign claiming it is one. Faking a need, giving false statements to get documentation, or handing over a false document is also covered.
Can I bring my ESA into stores or restaurants in Kentucky?
No. Kentucky's public-access law for assistance dogs (KRS 258.500) and the ADA cover trained service animals. KRS 383.085 applies to housing.
Can I fly with my ESA from Louisville or Lexington?
Under 14 CFR Part 382, airlines at Louisville (SDF), Lexington (LEX) and Cincinnati/Northern Kentucky (CVG) may treat an ESA as a pet. A dog trained to do tasks for a psychiatric disability can still fly as a service animal.
Where do I file a housing complaint in Kentucky?
With the Kentucky Commission on Human Rights within one year (the commission says complaints must be signed and notarized), or with HUD within one year. A private Fair Housing Act lawsuit can be filed within two years.
Does an evaluation guarantee an ESA letter?
No. The provider decides after evaluating you, and may conclude that an ESA is not appropriate.
