Massachusetts ESA Letter for Housing
Emotional support animal evaluations for Boston, Worcester, Springfield, Cambridge, Lowell, Brockton, Quincy and New Bedford
When HUD narrowed federal ESA enforcement in 2026, Massachusetts held its ground. The MCAD confirmed that Chapter 151B still treats emotional support animals as assistance animals that landlords must consider.

Massachusetts ESA Laws at a Glance
Last reviewed November 2026 against official Massachusetts and federal sources.
There’s no ESA-specific statute in the Commonwealth. Protection comes from the disability provisions of M.G.L. c. 151B, read by MCAD and the courts to cover animals that provide emotional support.
Housing rights
Disability discrimination in housing, including refusing reasonable accommodations, is unlawful.MCAD statement
HUD’s rescission “does not change or limit” state protections. Assistance animal is an umbrella term.Documentation

Generally within 300 days, or with HUD within 1 year.2026 federal change: since May 22, 2026, HUD has reviewed untrained ESAs case by case. MCAD responded on July 31, 2026 that denying an assistance animal just because it doesn’t meet the federal “service animal” definition may still violate Massachusetts law.
The interactive process: Massachusetts landlords must evaluate each request individually and talk it through with you. A one-line refusal citing HUD isn’t the end of the conversation.

Massachusetts ESA Letter FAQ
Are ESAs still protected in Massachusetts after HUD's 2026 change?
Yes. On July 31, 2026, the Massachusetts Commission Against Discrimination (MCAD) said HUD's rescission of its federal assistance animal guidance does not change or limit protections under state law. Under M.G.L. c. 151B, "assistance animal" is an umbrella term that includes animals providing emotional support, and denying a request only because the animal isn't a federally defined service animal may violate Massachusetts law.
What Massachusetts law protects ESA owners?
Chapter 151B, the state anti-discrimination law, prohibits disability discrimination in housing, including failing to make reasonable accommodations. MCAD relies on c. 151B, its regulations, and the 2024 decision MCAD, Fortin and Evangelista v. Marty Green Properties, which treats assistance animals as an umbrella category.
What test does MCAD use for an ESA request?
Whether the accommodation is necessary to give a person with a disability an equal opportunity to use and enjoy their dwelling. Landlords must evaluate each request individually and engage in an interactive process.
What documentation can a Massachusetts landlord ask for?
According to the Massachusetts Office on Disability, a housing provider may verify an ESA by requesting a letter of support from a medical provider. There's no official state ESA registry, and no certification or ID is required.
Does Massachusetts have special rules for ESA letters?
No. Massachusetts sets no ESA letter format or waiting period. A reliable letter comes from a licensed provider who has evaluated you, confirms a disability and a disability-related need, and doesn't disclose your diagnosis.
Can I get a Massachusetts ESA letter through telehealth?
State law doesn't address how the evaluation is delivered. A telehealth evaluation can support your request when the provider is licensed to treat you in Massachusetts and the assessment is genuine.
Can a Massachusetts landlord charge a pet fee for my ESA?
MCAD's July 2026 statement doesn't address fees, and no Massachusetts statute sets an ESA fee rule. Ask in writing for pet fees to be waived as part of your accommodation. You remain responsible for damage your animal causes.
Can I bring my ESA into stores or restaurants in Massachusetts?
No. M.G.L. c. 272, § 98A gives public-access rights to people with service dogs. ESAs are protected in housing, not in public places.
Can I fly with my ESA from Boston Logan?
Under 14 CFR Part 382, airlines at Boston Logan (BOS) and Worcester (ORH) may treat an ESA as a pet. A psychiatric service dog trained to perform tasks can still fly as a service animal.
Where do I file an ESA housing complaint in Massachusetts?
With MCAD, generally within 300 days of the discrimination. You can also file with HUD within one year, though HUD now pursues ESA cases only case by case, or bring a private Fair Housing Act lawsuit within two years.
Does an evaluation guarantee an ESA letter?
No. A licensed provider decides after evaluating you and may conclude that an ESA isn't appropriate.
