Emotional support animal evaluations for Detroit, Grand Rapids, Warren, Sterling Heights, Ann Arbor, Lansing, Flint and Kalamazoo

Michigan tenants with disabilities are protected by the Persons with Disabilities Civil Rights Act, which requires reasonable accommodations in housing rules. Michigan never enacted extra ESA letter rules, so there’s no state waiting period.

Michigan ESA Laws at a Glance

Last reviewed November 2026 against official Michigan and federal sources.

Michigan’s ESA rules come from general disability law. Lawmakers tried to add an ESA statute in 2020, but it was vetoed, leaving the PWDCRA and the federal Fair Housing Act as the framework.

Housing rights

MCL 37.1506a

Refusing reasonable accommodations in rules, policies, practices or services is unlawful (see also 37.1502).

ESA letter rules

HB 4910/4911 vetoed

No state letter format, waiting period or ESA misrepresentation crime.

Service animals

MCL 750.502c

Public access for service animals. Faking one is a misdemeanor (MCL 752.62).

Where to file a complaint

Michigan Dept. of Civil Rights

Within 180 days of the incident, or with HUD within 1 year.

Watch the 180-day clock: the Michigan Department of Civil Rights accepts complaints within 180 days of the discriminatory act. If a landlord refuses your ESA, write down the date and don’t wait to file.

2026 federal change: since May 22, 2026, HUD has reviewed untrained ESAs case by case. The Fair Housing Act’s text and Michigan’s PWDCRA are unchanged, so a clear request supported by a licensed provider’s letter remains your best footing.

What Makes a Michigan ESA Letter Credible

With no state template, Michigan landlords judge letters by federal fair housing standards. Look for:

  • Provider letterhead, signature and date
  • License type, number and state, so the landlord can verify it
  • Confirmation of a disability, without naming the diagnosis
  • A clear link between the animal and your disability-related need
  • Each animal identified by type and name
  • An evaluation by a provider who can treat Michigan patients

Who may qualify: Michiganders with a mental or emotional disability, such as anxiety, depression, PTSD or seasonal affective disorder, when an animal eases symptoms that limit daily life.

Keep the roles separate: an ESA isn’t a service animal in Michigan, and presenting one as a service animal can lead to misdemeanor charges under MCL 752.62.

Michigan ESA Letter FAQ

Does Michigan have an emotional support animal law?

No. Michigan has no ESA-specific statute. The Legislature passed HB 4910 and HB 4911 in the 2019–2020 session, which would have set ESA documentation rules and penalties for misrepresentation, but Governor Whitmer vetoed them on December 30, 2020, calling the added requirements too great an intrusion on the privacy of people with disabilities. ESA requests in Michigan rest on the Persons with Disabilities Civil Rights Act and the federal Fair Housing Act.

Which Michigan law protects ESA owners in housing?

The Persons with Disabilities Civil Rights Act (PWDCRA). MCL 37.1502 bars disability discrimination in real estate transactions, and MCL 37.1506a makes it unlawful to refuse reasonable accommodations in rules, policies, practices or services when needed to give a person with a disability equal opportunity to use and enjoy a dwelling.

Is there a waiting period or required letter format in Michigan?

No. Because the 2020 ESA bills were vetoed, Michigan has no 30-day relationship rule, no mandatory letter contents and no ESA-specific provider list. A dependable letter still comes from a licensed professional who has evaluated you.

Can I get a Michigan ESA letter through telehealth?

Yes, Michigan law places no ESA-specific limit on telehealth. The provider should be licensed to treat patients located in Michigan and should conduct a real clinical evaluation.

Can a Michigan landlord charge a pet deposit for my ESA?

Michigan law doesn't set an ESA fee rule. Request in writing that pet fees and deposits be waived as part of your accommodation. Your normal security deposit can still cover damage the animal causes.

When can a Michigan landlord deny an ESA?

Generally when the accommodation isn't reasonable: for example, an animal that poses a direct threat, would cause substantial damage that can't be reduced, or would impose an undue burden. Since HUD's May 22, 2026 policy change, untrained ESAs are reviewed case by case federally, so a well-supported request under the PWDCRA matters.

Is it a crime to fake a service animal in Michigan?

Yes, for service animals. MCL 752.62 and 752.63 make misrepresenting a service animal a misdemeanor punishable by up to 90 days in jail, a fine of up to $500 and/or up to 30 days of community service. Michigan has no comparable crime specific to ESAs, but never present an ESA as a service animal.

Can I take my ESA into stores or restaurants in Michigan?

No. Michigan's public-access law (MCL 750.502c) and the ADA cover service animals that are trained to perform tasks, not ESAs.

Can I fly with my ESA from Detroit?

Under 14 CFR Part 382, airlines at Detroit Metro (DTW), Grand Rapids (GRR), Flint (FNT) and Lansing (LAN) may treat an ESA as a pet. A task-trained psychiatric service dog can still fly as a service animal.

Where do I file a housing complaint in Michigan?

With the Michigan Department of Civil Rights within 180 days of the incident, or with HUD within one year. A private Fair Housing Act lawsuit can be filed within two years. Michigan's 180-day window is shorter than in many states, so act quickly.

Does an evaluation guarantee an ESA letter?

No. A licensed provider decides after evaluating you, and may decide that an ESA isn't the right fit.
