Emotional support animal evaluations for Jackson, Gulfport, Southaven, Hattiesburg, Biloxi, Tupelo, Meridian and Oxford

Mississippi has no state ESA law, so renters here rely on the federal Fair Housing Act. After HUD’s 2026 policy shift, that makes a well-documented letter from a licensed professional more important than ever.

Mississippi ESA Laws at a Glance

Last reviewed November 2026 against official Mississippi and federal sources.

In Mississippi, state law adds no protections for ESA owners. The state’s Support Animal Act sounds relevant but covers only trained dogs and miniature horses in public places.

Housing rights

42 U.S.C. § 3604(f)(3)(B)

Federal law bars refusing reasonable accommodations in rules, policies, practices or services.

State ESA law

None

No Mississippi ESA letter rules, fee limits or misrepresentation penalties.

“Support animal” act

Miss. Code §§ 43-6-151 to -155

Means a trained dog or miniature horse with public-access rights, not an ESA.

Where to file a complaint

U.S. Dept. of Housing & Urban Development

No state housing agency. HUD within 1 year; private suit within 2 years.

2026 federal change, and why it matters here: since May 22, 2026, HUD has generally pursued charges only for individually trained animals and reviews untrained ESAs case by case. With no state law to fall back on, Mississippi renters feel this change more directly than renters in most states.

What still works: the Fair Housing Act’s text hasn’t changed, landlords can still approve ESAs, and private lawsuits remain available. A specific, verifiable letter and a polite written request give you the best chance.

Making the Strongest Mississippi ESA Request

With only federal law in play, the quality of your request does the heavy lifting:

  • A letter from a licensed professional who actually evaluated you
  • License type, number and state, with signature and date
  • A clear statement of disability and disability-related need, no diagnosis
  • A short written request asking to waive no-pet rules and pet fees
  • Each animal identified, with vaccination and local licensing records
  • Copies of every message, in case you need to contact HUD

Who may qualify: Mississippians with a mental or emotional disability, such as anxiety, depression or PTSD, when an animal relieves symptoms that substantially limit daily life.

Federally funded housing and campuses: Section 504 of the Rehabilitation Act also requires reasonable accommodations in housing that receives federal funds, separate from HUD’s Fair Housing Act enforcement.

Mississippi ESA Letter FAQ

Does Mississippi have an emotional support animal law?

No. Mississippi has no statute that covers ESAs in housing, no ESA letter rules and no ESA misrepresentation penalty. ESA housing requests in Mississippi rely on the federal Fair Housing Act, plus Section 504 of the Rehabilitation Act for federally funded housing.

Isn't the Mississippi Support Animal Act about ESAs?

No, despite the name. In Miss. Code § 43-6-153, a "support animal" is a dog or miniature horse individually trained to do work or perform tasks for a person with a disability, and the term excludes pets. That act (§ 43-6-155) gives public-access rights to people with trained animals; it does not cover untrained emotional support animals or rental housing.

What protects Mississippi renters with ESAs?

The federal Fair Housing Act, 42 U.S.C. § 3604(f)(3)(B), which makes it discrimination to refuse reasonable accommodations in rules, policies, practices or services when they may be necessary for a person with a disability to use and enjoy a dwelling. Mississippi has no state fair housing agency, so complaints go to HUD.

How does the 2026 HUD change affect Mississippi more than other states?

On May 22, 2026, HUD said it will generally pursue charges only for animals individually trained to provide disability-related assistance, and review untrained ESAs case by case. Many states have their own laws or agencies that still protect ESAs, but Mississippi relies on federal law alone. The Fair Housing Act's text hasn't changed and private lawsuits remain possible, but a Mississippi ESA request now depends more on a strong letter and a cooperative landlord.

Is an ESA letter still worth it in Mississippi?

For many renters, yes. Landlords can still grant ESA accommodations, many Mississippi property managers follow written reasonable accommodation policies, and universities such as Southern Miss publish their own ESA procedures. A letter from a licensed professional is what those processes ask for.

Who can write an ESA letter in Mississippi?

Mississippi sets no list. Use a licensed health or mental health professional who is licensed to treat you in Mississippi, has evaluated you, and can confirm a disability and a disability-related need for the animal.

Can a Mississippi landlord charge pet fees for an ESA?

No Mississippi law addresses ESA fees. Ask in writing that pet fees and deposits be waived as part of your accommodation request. You remain responsible for damage your animal causes.

Can I bring my ESA into stores or restaurants in Mississippi?

No. Mississippi's public-access law and the ADA cover trained animals. An untrained ESA has no public-access rights, and presenting one as a trained support or service animal is misleading.

Can I fly with my ESA from Jackson or Gulfport?

Under 14 CFR Part 382, airlines at Jackson (JAN), Gulfport-Biloxi (GPT) and nearby Memphis (MEM) may treat an ESA as a pet. A psychiatric service dog trained to perform tasks can still fly as a service animal.

Where do I file an ESA housing complaint in Mississippi?

With HUD within one year of the discrimination. You can also file a private Fair Housing Act lawsuit within two years, which doesn't depend on HUD's enforcement priorities.

Does an evaluation guarantee an ESA letter?

No. A licensed professional decides after evaluating you and may conclude that an ESA isn't appropriate.
