Missouri ESA Laws at a Glance

Last reviewed November 2026 against official Missouri and federal sources.

Missouri splits the subject between two chapters: Chapter 213 (the Human Rights Act) for housing rights, and Chapter 209 for definitions and penalties, updated by SB 644 in 2020.

Housing rights

RSMo § 213.040.2(2)

Refusing reasonable accommodations in rules, policies, practices or services is discrimination.

ESA definition

RSMo § 209.204.3

Assistance animals include animals giving emotional support that eases identified effects of a disability.

Misrepresentation

RSMo § 209.204.3

False documents, fake vests or lying to a provider: class C misdemeanor plus damages.

Where to file a complaint

Missouri Commission on Human Rights

Within 180 days (RSMo § 213.075), or with HUD within 1 year.

Honesty is a legal requirement here: Missouri makes it a misdemeanor to knowingly misstate a material fact to a health care provider to get ESA documentation. Answer every evaluation question truthfully.

2026 federal change: since May 22, 2026, HUD has reviewed untrained ESAs case by case. The Fair Housing Act’s text is unchanged, Missouri law still names emotional support animals, and the Human Rights Act still requires reasonable accommodations. File within 180 days if you’re refused.

Staying on the Right Side of Missouri Law

Because § 209.204 criminalizes several shortcuts, a Missouri ESA request should be clean:

  • Documentation from a qualified, licensed professional who evaluated you
  • Truthful answers during the evaluation, with nothing exaggerated
  • License type, number and state on the letter, with signature and date
  • A statement of disability-related need that doesn’t name the diagnosis
  • No service-animal vest, collar or sign on your ESA
  • A written request to your landlord, filed with MCHR within 180 days if refused

Who may qualify: Missourians with a mental or emotional disability, for example anxiety, depression, PTSD or bipolar disorder, when an animal eases identified effects of that disability.

Military families: on-post housing at Fort Leonard Wood and Whiteman AFB follows installation pet rules, so check with the housing office as well.

Missouri ESA Letter FAQ

Does Missouri recognize emotional support animals?

Yes. RSMo § 209.204.3, amended in 2020 by SB 644, defines an assistance animal to include an animal that provides emotional support alleviating one or more identified effects of a person's disability. That section is mainly a misrepresentation law, but it puts ESAs into Missouri statute by name.

Which Missouri law protects ESA owners in housing?

The Missouri Human Rights Act. RSMo § 213.040.2(2) defines housing discrimination to include refusing reasonable accommodations in rules, policies, practices or services when needed to give a person with a disability equal opportunity to use and enjoy a dwelling. The federal Fair Housing Act applies as well.

Is it a crime to fake an ESA in Missouri?

Yes. Knowingly misrepresenting an animal as an assistance animal to get a Fair Housing Act or Rehabilitation Act accommodation is a class C misdemeanor, a class B misdemeanor for repeat violations, and carries civil liability for actual damages (RSMo § 209.204.3).

What counts as misrepresentation in Missouri?

Examples in § 209.204.3 include knowingly creating or giving someone a document that falsely says an animal is an assistance animal, knowingly fitting a non-assistance animal with a harness, collar, vest or sign used to identify assistance animals, and knowingly misstating a material fact to a health care provider to get ESA documentation.

Who can write an ESA letter in Missouri?

Missouri requires that assistance animal documentation come from a qualified professional, as permitted under the Fair Housing Act or the Rehabilitation Act. In practice, that means a licensed health or mental health professional, licensed to treat you in Missouri, who has evaluated you.

Is there a waiting period or required format for a Missouri ESA letter?

No. Missouri sets no 30-day rule and no template. Be completely honest during your evaluation: misstating facts to a provider to get documentation is itself a misdemeanor in Missouri.

Can I get a Missouri ESA letter through telehealth?

Yes. Missouri law doesn't restrict ESA evaluations to in-person visits. The provider should hold a license that allows them to treat patients in Missouri.

Can a Missouri landlord charge a pet fee for my ESA?

Missouri statute doesn't set an ESA fee rule. Ask in writing for pet fees and deposits to be waived as part of the accommodation. You remain responsible for damage your animal causes. Since HUD's May 22, 2026 policy change, untrained ESAs are reviewed case by case federally, so a clear request under the Missouri Human Rights Act helps.

Can I take my ESA into stores or restaurants in Missouri?

No. Missouri's public-access law (RSMo § 209.150) and the ADA cover service dogs. Misrepresenting a dog as a service dog in public is a separate misdemeanor under § 209.204.2.

Can I fly with my ESA from St. Louis or Kansas City?

Under 14 CFR Part 382, airlines at St. Louis Lambert (STL), Kansas City (MCI), Springfield-Branson (SGF) and Columbia (COU) may treat an ESA as a pet. A task-trained psychiatric service dog still flies as a service animal.

Where do I file a housing complaint in Missouri?

With the Missouri Commission on Human Rights within 180 days of the discrimination (RSMo § 213.075), or with HUD within one year. A private Fair Housing Act lawsuit can be filed within two years.

Does an evaluation guarantee an ESA letter?

No. A licensed professional decides after evaluating you and may conclude an ESA isn't appropriate.
