Montana ESA Laws at a Glance
Last reviewed November 2026 against official Montana and federal sources.
Montana added an ESA section to its Residential Landlord and Tenant Act in 2023 and tightened it in 2025. It works alongside the housing protections in the Montana Human Rights Act.

§ 70-24-114(5): these alone don’t establish a disability-related need.Where to file a complaint
Within 180 days (§ 49-2-501), or with HUD within 1 year.Start a month early: a Montana practitioner can’t provide supporting information until 30 days after your client-provider relationship begins. If you’re moving to Bozeman or Missoula for the fall, plan ahead.
2026 federal change: since May 22, 2026, HUD has reviewed untrained ESAs case by case. Montana’s statute still lets tenants request ESAs and requires landlords to answer in writing, and a letter that meets § 70-24-114 gives a landlord a clear, verifiable basis.

Montana ESA Letter FAQ
Does Montana have an emotional support animal law?
Yes. Mont. Code Ann. § 70-24-114, in the Residential Landlord and Tenant Act, was enacted in 2023 and amended in 2025. It defines an emotional support animal as an animal a health care practitioner has determined provides emotional, cognitive or similar support to a person with a disability, without any training or certification requirement.
Who can write an ESA letter in Montana?
A "health care practitioner" under § 70-24-114: a mental health professional, as defined in § 53-21-102, who is licensed to practice in Montana. That includes physicians, licensed clinical professional counselors, psychologists, clinical social workers, marriage and family therapists, psychiatric-mental-health APRNs and PAs, and certified professional persons.
Is there a 30-day rule in Montana?
Yes. The practitioner must have established a client-provider relationship with you at least 30 days before providing the supporting information, and must have completed a clinical evaluation of your need for an ESA.
What must a Montana ESA letter include?
It must identify the specific assistance or therapeutic support the particular animal provides, and list the practitioner's license effective date, license number and license type. Each animal needs its own supporting information.
Can I get a Montana ESA letter through telehealth?
Section 70-24-114 doesn't say whether the relationship must be in person. What it does require is a Montana-licensed mental health professional, a relationship of at least 30 days and a clinical evaluation, so confirm those three points before you book.
Do online ESA registrations count in Montana?
No. The statute says an ESA registration of any kind, including an ID card, patch or certificate obtained online or in person, does not by itself establish a disability-related need.
What can a Montana landlord ask for?
If your need isn't readily apparent, supporting information from a qualifying practitioner (or another source the landlord reasonably considers reliable under fair housing law), plus proof of state and local licensing and vaccinations. The landlord may not ask for your diagnosis, its severity or your medical records, and must give you a written determination.
When can a Montana landlord deny an ESA?
When the animal poses a direct threat to the safety or health of others, or a direct threat of physical damage to property that another reasonable accommodation can't reduce. You're liable for damage the animal causes. Since HUD's May 22, 2026 policy change, untrained ESAs are reviewed case by case federally, but Montana's statute still sets the state process.
Can a Montana landlord charge a pet fee for my ESA?
Section 70-24-114 doesn't address fees. Ask in writing that pet fees and deposits be waived as part of your accommodation request.
Can I take my ESA into stores or restaurants in Montana?
No. Montana's public-access law for service animals (§ 49-4-214) doesn't cover ESAs, and § 70-24-114 expressly excludes service animals from its ESA rules.
Can I fly with my ESA from Bozeman or Billings?
Under 14 CFR Part 382, airlines at Bozeman (BZN), Billings (BIL), Missoula (MSO), Kalispell (FCA) and Great Falls (GTF) may treat an ESA as a pet. A task-trained psychiatric service dog can still fly as a service animal.
Where do I file a housing complaint in Montana?
With the Montana Human Rights Bureau within 180 days of the discrimination, or with HUD within one year. A private Fair Housing Act lawsuit can be filed within two years.
