Nebraska ESA Letter by Telehealth
Emotional support animal evaluations for Omaha, Lincoln, Bellevue, Grand Island, Kearney, Fremont and Norfolk
Nebraska renters with disabilities are covered by the Nebraska Fair Housing Act. Section 20-319 treats refusing a reasonable accommodation, such as an exception to a no-pet rule, as discrimination.

Nebraska ESA Laws at a Glance
Last reviewed November 2026 against official Nebraska and federal sources.
The Unicameral hasn’t passed an ESA statute, so the rules come from Nebraska’s own fair housing law, enforced by the Nebraska Equal Opportunity Commission, and from federal law.
Housing rights
Refusing reasonable accommodations in rules, policies, practices or services is discrimination.ESA letter rules
None in Nebraska statute
No set format, provider list or waiting period. Federal practice guides landlords.Service animals
Public-access rights for service animals only. Interference is a Class III misdemeanor.Where to file a complaint
Nebraska Equal Opportunity Commission
Within 1 year (§ 20-326), or with HUD within 1 year.Housing vs. public places: NEOC gives you one year to file a housing complaint, but only 10 days for a public accommodation complaint. An ESA dispute with a landlord falls under the one-year housing rule.
2026 federal change: since May 22, 2026, HUD has reviewed untrained ESAs case by case. Nebraska’s § 20-319 still requires reasonable accommodations, so pair a solid letter with a written request.

A Nebraska Landlord Will Look For
Without a state template, these elements make a Nebraska ESA letter easy to accept:
- A licensed health or mental health professional’s signature and date
- License type, number and state for verification
- Confirmation of a disability, with no diagnosis named
- An explanation of the disability-related need for the animal
- Details on each animal included in the request
- A provider able to treat patients in Nebraska
Who may qualify: Nebraskans living with a mental or emotional disability, for example anxiety, depression, PTSD or panic disorder, when the animal reduces disability-related symptoms.
Military families: base housing at Offutt AFB has its own pet rules, so contact the housing office in addition to sending your request.
Nebraska ESA Letter FAQ
Is there a Nebraska ESA law?
Not a stand-alone one. Nebraska has no statute that defines emotional support animals or regulates ESA letters. Renters rely on the Nebraska Fair Housing Act (Neb. Rev. Stat. § 20-301 and following) and the federal Fair Housing Act, both of which require reasonable accommodations for people with disabilities.
Which section of Nebraska law covers ESA requests?
Neb. Rev. Stat. § 20-319(2)(b). It lists "a refusal to make reasonable accommodations in rules, policies, practices, or services" as discrimination when the accommodation may be necessary for a person with a disability to use and enjoy a dwelling. Asking a landlord to waive a no-pet rule for an ESA is that kind of accommodation.
What should a Nebraska ESA letter contain?
Nebraska prescribes no format, so landlords look to federal fair housing practice. A useful letter is signed and dated by a licensed professional, gives license details, confirms a disability and a disability-related need for the animal, and leaves out your diagnosis.
Is there a waiting period for ESA letters in Nebraska?
No. Nebraska has no 30-day relationship requirement, unlike neighboring Iowa and Montana. Your provider still needs to evaluate you genuinely before deciding.
Can I get a Nebraska ESA letter through telehealth?
Yes. Nebraska law sets no ESA-specific limits on telehealth. Choose a provider who holds a license allowing them to treat patients in Nebraska.
Can a Nebraska landlord charge a pet deposit for an ESA?
Nebraska's statutes don't address ESA fees. Include a request to waive pet fees and pet deposits in your written accommodation request. You can still be charged for damage your animal causes.
What changed with HUD in 2026?
On May 22, 2026, HUD said it would review untrained ESAs case by case rather than treating them like trained assistance animals for enforcement. The federal statute's text didn't change, and § 20-319 still requires Nebraska housing providers to make reasonable accommodations, so a clear, well-supported request remains the best approach.
Can I bring my ESA into stores or restaurants in Nebraska?
No. Neb. Rev. Stat. § 20-127 gives public-access rights to people with service animals. ESAs don't have those rights. Interfering with a service animal is a Class III misdemeanor (§ 28-1009.01).
Can I fly with my ESA from Omaha?
Under 14 CFR Part 382, airlines at Omaha Eppley (OMA), Lincoln (LNK) and Grand Island (GRI) may treat an ESA as a pet. A psychiatric service dog trained to perform tasks can still fly as a service animal.
Where do I file a housing complaint in Nebraska?
With the Nebraska Equal Opportunity Commission (NEOC) within one year of the discriminatory housing practice (§ 20-326), or with HUD within one year. A private Fair Housing Act lawsuit can be filed within two years.
Does an evaluation guarantee an ESA letter?
No. A licensed provider decides after evaluating you and may conclude that an ESA isn't right for you.
