Emotional support animal evaluations for Manchester, Nashua, Concord, Dover, Rochester, Portsmouth, Keene and Derry

The Granite State relies on its Law Against Discrimination for ESA housing rights. RSA 354-A:11 makes refusing a reasonable accommodation, like an exception to a no-pet policy, a civil rights violation.

New Hampshire ESA Laws at a Glance

Last reviewed November 2026 against official New Hampshire and federal sources.

New Hampshire has no ESA-specific statute. Its fair housing chapter, reorganized effective 2022, carries the reasonable accommodation duty, and the Commission for Human Rights enforces it.

NH Commission for Human Rights

Within 180 days (300 in certain cases), or with HUD within 1 year.

Move fast if you’re refused: the Commission for Human Rights says a charge must be filed within 180 days in most cases. Keep dated copies of your request and the landlord’s answer.

2026 federal change: since May 22, 2026, HUD has reviewed untrained ESAs case by case. RSA 354-A:11 still requires New Hampshire housing providers to make reasonable accommodations, so a well-supported request keeps its state-law footing.

Preparing Your New Hampshire ESA Request

Because the state has no letter template, a complete package carries the request:

  • A letter from a licensed professional who evaluated you
  • License type, number and state, with signature and date
  • A statement of disability and need for the animal, without the diagnosis
  • A written request to waive the no-pet rule and pet fees
  • Vaccination and town dog license records for each animal
  • Dated copies of everything, given the 180-day filing window

Who may qualify: people in New Hampshire with a mental or emotional disability, including anxiety, depression, PTSD or seasonal affective disorder, when an animal helps with symptoms that limit daily life.

Town licensing still applies: New Hampshire dogs must be licensed with their town or city, and a landlord may ask to see current records.

New Hampshire ESA Letter FAQ

Does New Hampshire have an emotional support animal law?

No. New Hampshire has no statute that defines ESAs or regulates ESA letters. ESA requests rest on the state Law Against Discrimination (RSA 354-A) and the federal Fair Housing Act, both of which require reasonable accommodations for tenants with disabilities.

Which New Hampshire law covers ESA requests?

RSA 354-A:11, the fair housing section on disability, effective January 1, 2022. Paragraph III(b) makes it a civil rights violation to refuse reasonable accommodations in rules, policies, practices or services when needed for a person with a disability to have equal opportunity to use and enjoy a dwelling.

What should a New Hampshire ESA letter include?

There's no state format. A credible letter is signed and dated by a licensed health or mental health professional, lists license details, confirms that you have a disability and a disability-related need for the animal, and doesn't name your diagnosis.

Is there a waiting period for ESA letters in New Hampshire?

No. New Hampshire sets no 30-day relationship rule. The provider should still conduct a real evaluation before deciding.

Can I get a New Hampshire ESA letter through telehealth?

Yes. State law places no ESA-specific limits on telehealth. Choose a provider licensed to treat patients in New Hampshire.

Can a New Hampshire landlord charge a pet fee for my ESA?

New Hampshire statutes don't set an ESA fee rule. Include a request to waive pet rent, pet fees and pet deposits in your written accommodation request. You're still responsible for damage the animal causes.

How does the 2026 HUD change affect New Hampshire?

Since HUD's May 22, 2026 policy change, untrained ESAs are reviewed case by case for federal enforcement. RSA 354-A:11 continues to require reasonable accommodations, and the New Hampshire Commission for Human Rights handles state fair housing complaints.

Does New Hampshire's service animal law apply to ESAs?

No. RSA 167-D covers service animals, which are trained to do work or tasks. Knowingly misrepresenting an animal as a service animal is a misdemeanor in New Hampshire, so never present an ESA as one.

Can I take my ESA into stores or restaurants in New Hampshire?

No. Public-access rights under RSA 167-D:4 and the ADA belong to service animals.

Can I fly with my ESA from Manchester or Portsmouth?

Under 14 CFR Part 382, airlines at Manchester–Boston (MHT), Portsmouth (PSM) and nearby Boston Logan (BOS) may treat an ESA as a pet. A task-trained psychiatric service dog still flies as a service animal.

Where do I file a housing complaint in New Hampshire?

With the New Hampshire Commission for Human Rights. The commission says a charge must be filed within 180 days, extended to 300 days in certain circumstances. You can also file with HUD within one year or bring a private Fair Housing Act lawsuit within two years.

Does an evaluation guarantee an ESA letter?

No. A licensed provider decides after evaluating you and may conclude an ESA isn't the right fit.
