Emotional support animal evaluations for Albuquerque, Las Cruces, Rio Rancho, Santa Fe, Roswell, Farmington and Clovis
New Mexico defines emotional support animals in statute and protects tenants with disabilities through the New Mexico Human Rights Act. Paired with the federal Fair Housing Act, that gives you a path to ask for an exception to a no-pet rule.

New Mexico ESA Laws at a Glance
Last reviewed November 2026 against official New Mexico and federal sources.
Two New Mexico laws touch ESAs: the Assistance Animal Act, which defines them and separates them from service animals, and the Human Rights Act, which protects tenants with disabilities.
Housing rights
No disability discrimination in housing terms, conditions, facilities or services.ESA definition
An animal selected to accompany a person with a disability that doesn’t work or perform tasks.Accommodation duty
Federal law requires reasonable accommodations in rules, policies, practices or services.Where to file a complaint
Within 300 days (§ 28-1-10), or with HUD within 1 year.ESAs are not service animals here: New Mexico’s own definition says an ESA doesn’t work or perform tasks. Presenting one as a qualified service animal is a misdemeanor under § 28-11-6.
2026 federal change: since May 22, 2026, HUD has reviewed untrained ESAs case by case. The federal statute’s text hasn’t changed and New Mexico’s Human Rights Act still bans disability discrimination in housing, so a clear, documented request matters.

New Mexico has no letter template, so landlords rely on fair housing practice. Include:
- The provider’s signature, date and letterhead
- License type, number and state for verification
- Confirmation of a physical or mental disability, with no diagnosis
- How the animal relates to that disability
- Each animal covered by the request
- A provider able to treat New Mexico patients
Who may qualify: New Mexicans with a mental or emotional disability, such as anxiety, depression or PTSD, when an animal eases disability-related symptoms.
Military families: housing at Kirtland, Holloman and Cannon AFB follows installation pet policies, so contact the housing office too.
New Mexico ESA Letter FAQ
Does New Mexico law mention emotional support animals?
Yes, by definition. The Assistance Animal Act, NMSA 1978 § 28-11-2(A), defines an "emotional support animal" (along with comfort and therapy animals) as an animal selected to accompany a person with a disability that does not work or perform tasks. The definition separates ESAs from qualified service animals; the Act itself deals with public access, not housing.
What protects New Mexico renters with ESAs?
The New Mexico Human Rights Act, § 28-1-7(G), bars discrimination in the sale or rental of housing, including in its terms, conditions, facilities or services, based on physical or mental disability. The federal Fair Housing Act, 42 U.S.C. § 3604(f)(3)(B), adds an express duty to make reasonable accommodations in rules, policies, practices or services.
Does New Mexico have rules for ESA letters?
No. New Mexico sets no letter format, provider list or waiting period. A strong letter comes from a licensed health or mental health professional who evaluated you, lists license details, and confirms a disability and a disability-related need without naming the diagnosis.
Can I get a New Mexico ESA letter through telehealth?
Yes. State law doesn't restrict how ESA evaluations are delivered, which helps in rural areas far from Albuquerque or Las Cruces. Use a provider licensed to treat patients in New Mexico.
Can I bring my ESA into stores or restaurants in New Mexico?
No. Because § 28-11-2 separates ESAs from qualified service animals, ESAs don't get public-access rights. Knowingly presenting an animal as a qualified service animal when it isn't one is a misdemeanor under § 28-11-6.
Can a New Mexico landlord charge a pet fee for my ESA?
There's no New Mexico statute on ESA fees. When you submit your request, include a line asking the landlord to waive pet rent, pet fees and any pet deposit for the ESA. Your ordinary security deposit can still be used for real damage.
How did HUD's 2026 change affect New Mexico?
HUD announced on May 22, 2026 that its enforcement staff would weigh untrained ESA cases individually. Congress hasn't changed the Fair Housing Act, and New Mexico's Human Rights Act still prohibits disability discrimination by housing providers. Keep a written record of what you asked for and how the landlord replied.
Can I fly with my ESA from Albuquerque?
Not as an ESA. Federal air travel rules (14 CFR Part 382) let carriers flying out of the Albuquerque Sunport (ABQ), Santa Fe (SAF) or El Paso (ELP) handle ESAs under their pet policies. Psychiatric service dogs that are trained to perform tasks keep service animal status on flights.
Where do I file a housing complaint in New Mexico?
New Mexico gives you 300 days to file with the Human Rights Bureau at the Department of Workforce Solutions (§ 28-1-10). HUD accepts housing complaints for one year, and you have two years to sue privately under the Fair Housing Act.
Does an evaluation guarantee an ESA letter?
No. The outcome rests on a licensed provider's clinical judgment, and some evaluations end with a recommendation other than an ESA.
