What an Ohio Landlord Can Reasonably Expect
Following Ohio civil rights guidance, a solid request includes:
- Reliable documentation from a licensed medical or mental health provider
- Confirmation that you have a disability, not your specific condition
- An explanation of the disability-related need for the animal
- License type, number and state, with signature and date
- No online certificate or registration in place of a letter
- A written request to waive the no-pet rule and pet fees
Who may qualify: Ohioans with a mental or emotional disability, such as anxiety, depression, PTSD or panic disorder, when an animal gives therapeutic benefit through its presence.
Military families: housing at Wright-Patterson AFB follows installation pet policies, so contact the housing office as well.
Ohio ESA Letter FAQ
Does Ohio protect emotional support animals in housing?
Yes, under the Ohio Civil Rights Act. Ohio Rev. Code § 4112.02(H)(19) makes it unlawful to refuse reasonable accommodations in rules, policies, practices or services when necessary for a person with a disability to use and enjoy a dwelling. Ohio has no separate ESA statute.
What is an "animal assistant" in Ohio?
It's the umbrella term Ohio civil rights guidance uses for any animal that aids a person with a disability. According to the Ohio Attorney General's Civil Rights Reporter, it covers both service animals that perform tasks and emotional support animals that provide therapeutic benefit simply by being with the person.
What documentation can an Ohio landlord ask for?
When the need isn't obvious, a housing provider may request reliable medical documentation of a disability and the related need for the animal. The provider can't demand your full medical history or specific diagnosis; the documentation should establish that you have a disability, not the specific condition.
Do ESA certificates or registrations count in Ohio?
No. Ohio civil rights guidance says there is no recognized "certificate" or "license" for animal assistants. What matters is reliable documentation from a medical or mental health provider.
Is there a waiting period or required letter format in Ohio?
No. Ohio sets no 30-day rule, provider list or template for ESA letters.
Can I get an Ohio ESA letter through telehealth?
Yes. Ohio law doesn't restrict ESA evaluations to in-person visits. Use a provider licensed to treat patients located in Ohio.
Can an Ohio landlord charge a pet deposit for my ESA?
Ohio statutes don't set an ESA fee rule. Ask in writing for pet fees and deposits to be waived as part of your accommodation. Under Ohio guidance, actual damage caused by the animal can be addressed like any other damage a tenant causes.
How did HUD's 2026 change affect Ohio?
HUD said on May 22, 2026 that it would review untrained ESAs case by case for federal enforcement. Ohio's § 4112.02(H)(19) still requires reasonable accommodations, and the Ohio Civil Rights Commission continues to take housing charges.
Can I take my ESA into stores or restaurants in Ohio?
No. Ohio Rev. Code § 955.43 gives public-access rights to people with assistance dogs. Ohio guidance says housing providers must be more accommodating of animal assistants than businesses are.
Can I fly with my ESA from Columbus or Cleveland?
Under 14 CFR Part 382, airlines at Columbus (CMH), Cleveland Hopkins (CLE), Dayton (DAY), Akron-Canton (CAK) and Cincinnati/Northern Kentucky (CVG) may treat an ESA as a pet. A task-trained psychiatric service dog still flies as a service animal.
Where do I file a housing complaint in Ohio?
With the Ohio Civil Rights Commission within one year of the most recent discriminatory act, or with HUD within one year. A private Fair Housing Act lawsuit can be filed within two years.
Does an evaluation guarantee an ESA letter?
No. A licensed provider decides after evaluating you and may determine an ESA isn't appropriate.
