South Carolina ESA Laws at a Glance

Last reviewed November 2026 against official South Carolina and federal sources.

The South Carolina Fair Housing Law holds both the general accommodation duty and, since Act 44 of 2019, a specific rule for animals that aren’t service animals.

Housing rights

S.C. Code § 31-21-70(G)(2)

Refusing reasonable accommodations in rules, policies, practices or services is discrimination.

ESA documentation

S.C. Code § 31-21-70(N)

Sufficient if it shows a disability and that the animal gives assistance or emotional support.

Two landlord questions

Act 44 of 2019

Do you have a disability? Do you have a disability-related need for the animal?

Where to file a complaint

SC Human Affairs Commission

Within 180 days (§ 31-21-120), or with HUD within 1 year.

Act within 180 days: South Carolina’s state complaint window is about six months, half of HUD’s one year. If your landlord refuses, contact the Human Affairs Commission promptly.

2026 federal change: since May 22, 2026, HUD has reviewed untrained ESAs case by case. South Carolina’s statute still names emotional support as a valid basis, so a letter that tracks § 31-21-70(N) carries weight with landlords.

What a South Carolina ESA Letter Should Establish

To be “deemed sufficient” under § 31-21-70(N)(2), your letter should:

  • Establish that you have a physical or mental impairment that substantially limits a major life activity
  • Establish that the animal provides disability-related assistance or emotional support
  • Come from a licensed health or mental health professional
  • Include license type, number and state, with signature and date
  • Leave out your diagnosis
  • Identify each animal in the request

Who may qualify: South Carolinians with a mental or emotional disability, such as anxiety, depression or PTSD, when an animal provides emotional support tied to that disability.

Military families: housing at Fort Jackson, Joint Base Charleston, Shaw AFB and MCAS Beaufort follows installation pet rules, so check with the housing office too.

South Carolina ESA Letter FAQ

Does South Carolina have an emotional support animal law?

Yes. Act 44 of 2019 added § 31-21-70(N) to the South Carolina Fair Housing Law. It covers "animals that are not service animals," including emotional support animals, and spells out the questions a landlord may ask and what documentation is enough.

What can a South Carolina landlord ask about my ESA?

Two questions: whether you have a disability, meaning a physical or mental impairment that substantially limits one or more major life activities, and whether you have a disability-related need for the animal. The landlord may request documentation to verify the answers.

What documentation is enough in South Carolina?

Under § 31-21-70(N)(2), documentation is deemed sufficient if it establishes that you have a disability and that the animal will provide some type of disability-related assistance or emotional support. South Carolina names emotional support explicitly.

Is there a waiting period or required provider in South Carolina?

No. South Carolina sets no 30-day rule and no provider list. A credible letter comes from a licensed health or mental health professional who has evaluated you.

Can I get a South Carolina ESA letter through telehealth?

Yes. South Carolina law doesn't restrict ESA evaluations to in-person visits. Choose a provider licensed to treat patients in South Carolina.

Can a South Carolina landlord charge a pet fee for my ESA?

Section 31-21-70(N) doesn't address fees. Ask in writing for pet rent, pet fees and pet deposits to be waived as part of the accommodation. You can be held responsible for damage the animal causes.

How did HUD's 2026 change affect South Carolina?

HUD said on May 22, 2026 that untrained ESAs would be reviewed case by case for federal enforcement. South Carolina's statute still expressly says documentation of emotional support is sufficient, and § 31-21-70(G)(2) still requires reasonable accommodations.

Can I take my ESA into stores or restaurants in South Carolina?

No. Public-access rights under S.C. Code § 43-33-20 belong to people with service animals. Misrepresenting a service animal can bring civil fines of $250, $500 and $1,000 for repeat violations (§ 47-3-980).

Can I fly with my ESA from Charleston or Columbia?

Under 14 CFR Part 382, airlines at Charleston (CHS), Columbia (CAE), Greenville-Spartanburg (GSP) and Myrtle Beach (MYR) may treat an ESA as a pet. A task-trained psychiatric service dog still flies as a service animal.

Where do I file a housing complaint in South Carolina?

With the South Carolina Human Affairs Commission within 180 days of the discriminatory practice (§ 31-21-120), or with HUD within one year. A private Fair Housing Act lawsuit can be filed within two years.

Does an evaluation guarantee an ESA letter?

No. A licensed provider decides after evaluating you and may not recommend an ESA.
