ESA Letter in Texas From a Licensed Therapist

Online emotional support animal evaluations for Texans — from Houston and Dallas to Austin, San Antonio and El Paso

If an animal helps you manage anxiety, depression, PTSD or another mental health condition, a licensed therapist can evaluate whether an ESA letter is appropriate for you, entirely online.

A Texas ESA letter is the documentation you give a landlord when you ask to keep your emotional support animal as a reasonable accommodation under federal and Texas fair housing law.

Texas ESA Laws at a Glance

Last reviewed November 2026 against official Texas and federal sources.

Texas does not have a separate ESA statute. Your rights as a renter come from two fair housing laws that work together: the federal Fair Housing Act and the Texas Fair Housing Act. Here is what that means in practice.

Housing law

Tex. Prop. Code ch. 301

The Texas Fair Housing Act bars disability discrimination in housing, including refusing reasonable accommodations (§ 301.025).

ESA letter rules

No Texas-specific rule

When your need isn’t obvious, a landlord may ask for reliable documentation from a licensed professional who knows your situation.

Fake ESA penalty

None for ESAs

Texas’s penalty in Hum. Res. Code § 121.006 covers service animals, not ESAs in housing.

Where to file a complaint

Texas Workforce Commission, Civil Rights Division

File within 1 year of the incident, or with HUD within 1 year.

2026 federal change: since May 22, 2026, HUD presumes accommodation requests reasonable only for animals individually trained to do work or tasks, and reviews requests for untrained ESAs case by case. The Fair Housing Act itself hasn’t changed and you can still bring a private claim, but clear documentation from a licensed professional who has actually evaluated you matters more than ever.

Where a Texas ESA Letter Helps — and Where It Doesn’t

Apartments & Rentals

Yes. This is what an ESA letter is for: asking a Texas landlord, property manager or HOA to make an exception to no-pet rules.

College Housing

Usually. UT, Texas A&M and other campuses review ESA requests through disability or housing services. Apply before move-in.

Flights

No. Airlines flying from DFW, IAH, AUS and SAT may treat an ESA as a pet with normal pet fees and carrier rules.

Stores & Restaurants

No. Only trained service animals have public-access rights under the ADA and Texas Human Resources Code Chapter 121.

Who May Qualify for an ESA Letter in Texas?

There is no list of conditions that automatically qualifies someone. A therapist looks at whether you have a mental or emotional disability that substantially limits daily life, and whether your animal genuinely helps with it.

Texans commonly seek an evaluation for:

  • Anxiety or panic attacks
  • Depression
  • PTSD or trauma-related symptoms
  • Other mental or emotional conditions that affect sleep, work, school or relationships

What a valid letter includes: the provider’s name, license type, license number and state; the date; and a statement that you have a disability and a disability-related need for the animal. It should not disclose your diagnosis.

An online certificate, registration or ID card on its own is not an ESA letter.

Texas ESA Letter FAQ

Does Texas have its own ESA letter law?

No. Texas has no statute that sets special requirements for ESA letters, unlike states such as California or Florida. ESA housing requests in Texas are handled under the federal Fair Housing Act and the Texas Fair Housing Act (Texas Property Code, Chapter 301), which both treat a request to keep an assistance animal as a reasonable-accommodation request.

Who can write an ESA letter in Texas?

A licensed health care professional who has evaluated you and knows your disability-related need, such as a licensed professional counselor (LPC), licensed clinical social worker (LCSW), psychologist, psychiatrist or physician. A professional providing care to someone located in Texas generally needs to be licensed to practice there.

Can a Texas landlord refuse my emotional support animal?

A landlord must consider your request as a reasonable accommodation. Since May 22, 2026, HUD presumes these requests reasonable only for individually trained animals and reviews requests for untrained ESAs case by case, so a Texas landlord may weigh your documentation and the specific facts. A request can also be denied if the animal poses a direct threat or would cause substantial damage. The Fair Housing Act itself has not changed.

Can a Texas landlord charge a pet deposit or pet rent for an ESA?

Texas law has no ESA-specific rule on pet fees. If your accommodation request is granted, ask in writing whether pet deposits, pet rent and breed or weight limits will be waived. You remain responsible for any damage your animal causes.

Is it illegal to fake an emotional support animal in Texas?

Texas has no ESA-specific misrepresentation penalty. Its fake-service-animal law (Human Resources Code § 121.006) covers service animals in public places, not ESAs in housing. Giving false information to a landlord can still lead to a denied request, a lease violation or a fraud claim.

Can I take my ESA into stores or restaurants in Texas?

No. Public-access rights under the ADA and Texas Human Resources Code Chapter 121 belong to trained service animals. Texas businesses may apply their own pet policies to emotional support animals.

Can I fly with my ESA from DFW, Houston, Austin or San Antonio?

Under the U.S. Department of Transportation's rules (14 CFR Part 382), airlines may treat emotional support animals as pets, so expect pet fees, carrier size limits and cabin caps. Check your airline's pet policy before booking. A trained psychiatric service dog is still accepted as a service animal.

Do Texas college dorms have to allow ESAs?

University housing is covered by the Fair Housing Act, and schools that receive federal funding must also follow Section 504 of the Rehabilitation Act. Most Texas universities handle ESA requests through their disability services or housing office, so contact them early, before move-in.

Where do I file a housing complaint in Texas?

With the Texas Workforce Commission's Civil Rights Division, or with HUD, within one year of the incident. A private Fair Housing Act lawsuit can be filed within two years.

How long is a Texas ESA letter valid?

Texas law sets no expiration date. Many landlords ask for documentation that is current, often within the last 12 months, so plan to renew when you sign or renew a lease.

Does getting an evaluation guarantee an ESA letter?

No. The licensed therapist decides, based on your individual evaluation, whether an ESA recommendation is appropriate. If it isn't, no letter is issued.
