Emotional support animal evaluations for Salt Lake City, West Valley City, Provo, Orem, Sandy, Ogden, St. George and Logan

Utah protects support animals in housing by statute. Under § 26B-6-803, landlords can’t discriminate because of one, including by charging an extra fee or deposit, though they may recover reasonable repair costs.

Utah ESA Laws at a Glance

Last reviewed November 2026 against official Utah and federal sources.

Utah covers ESAs in Title 26B, Chapter 6, Part 8 (rights of persons with disabilities) and in the Utah Fair Housing Act, enforced by the Labor Commission’s UALD.

Support animals

Utah Code § 26B-6-803

No discrimination based on a support animal, including extra fees or deposits.

Accommodations

Utah Code § 57-21-5(4)(b)

Refusing a reasonable accommodation in a rule, policy, practice or service is discriminatory.

Misrepresentation

Utah Code § 26B-6-805

Faking a support animal or lying to a provider for documentation: class C misdemeanor.

Where to file a complaint

Utah Antidiscrimination & Labor Division

UALD investigates within 180 days; 181–365 days go to HUD.

Tied to federal law: Utah defines a support animal as one that qualifies as a reasonable accommodation under federal law. Since May 22, 2026, HUD has reviewed untrained ESAs case by case for its own enforcement, so clear documentation of your disability-related need matters more than before.

What hasn’t changed: the Fair Housing Act’s text, Utah’s ban on extra fees and deposits for support animals, and the accommodation duty in Utah’s own Fair Housing Act.

Your Utah ESA Request, Step by Step

Utah law and UALD guidance point to a request that includes:

  • A letter from a licensed health or mental health provider
  • A clear description of the disability-related need, no diagnosis
  • License details, signature and date
  • A written request to keep the animal despite no-pet rules
  • No pet deposit or pet fee, since § 26B-6-803 bars them
  • Truthful information throughout, as § 26B-6-805 penalizes deception

Who may qualify: Utahns with a disability under the ADA definition, such as anxiety, depression or PTSD, when an animal is a reasonable accommodation for that disability.

Air Force families: housing at Hill AFB follows installation pet rules, so check with the housing office too.

Utah ESA Letter FAQ

Does Utah have an emotional support animal law?

Yes. Utah Code Title 26B, Chapter 6, Part 8 covers service and support animals. Section 26B-6-801 defines a "support animal" as an animal other than a service animal that qualifies as a reasonable accommodation under federal law, and § 26B-6-803 bars housing discrimination based on a support animal.

Can a Utah landlord charge a pet deposit for my ESA?

No. Under § 26B-6-803, an owner or lessor may not discriminate against a person because of a service or support animal, including by charging an additional fee or deposit. The landlord may recover a reasonable cost to repair damage the animal causes.

What documentation can a Utah landlord ask for?

Utah's support animal sections don't set a documentation format. Landlords generally follow federal fair housing practice: if the disability or need isn't obvious, they may ask for reliable information from a health care provider about the disability-related need. Utah's Antidiscrimination and Labor Division says no special certification is required.

Is it a crime to fake an ESA in Utah?

Yes. Under § 26B-6-805, it's a class C misdemeanor to knowingly and intentionally represent falsely that an animal is a service or support animal, or to misrepresent a material fact to a health care provider to obtain documentation designating an animal as a support animal.

Is there a waiting period for Utah ESA letters?

No. Utah sets no 30-day rule or provider list. Answer every evaluation question honestly, because lying to a provider to get documentation is itself a misdemeanor.

Can I get a Utah ESA letter through telehealth?

Yes. Utah law doesn't restrict ESA evaluations to in-person visits. Choose a provider licensed to treat patients in Utah.

Do weight or size limits apply to ESAs in Utah?

Utah's Antidiscrimination and Labor Division says size or weight limits shouldn't be applied to assistance animals, that they must be permitted despite no-pet rules, and that standard cleaning or damage deposits may apply only if all residents pay them.

How does the 2026 HUD change affect Utah?

Utah's support animal definition ties to what qualifies as a reasonable accommodation under federal law. The federal Fair Housing Act's text hasn't changed, but since May 22, 2026, HUD reviews untrained ESAs case by case for its own enforcement. Utah's Fair Housing Act, § 57-21-5(4)(b), still bars refusing reasonable accommodations, so a strong, individualized request matters.

Can I take my ESA into stores or restaurants in Utah?

No. Utah's definition of service animal excludes animals used solely for emotional support. ESAs are protected in housing, not public accommodations.

Can I fly with my ESA from Salt Lake City?

Under 14 CFR Part 382, airlines at Salt Lake City (SLC), Provo (PVU) and St. George (SGU) may treat an ESA as a pet. A psychiatric service dog trained to perform tasks still flies as a service animal.

Where do I file a housing complaint in Utah?

With the Utah Antidiscrimination and Labor Division (UALD). UALD investigates claims filed within 180 days and forwards claims filed between 181 and 365 days to HUD. A private lawsuit can be filed within two years.

Does an evaluation guarantee an ESA letter?

No. A licensed provider decides after evaluating you and may conclude an ESA isn't the right fit.
