Emotional support animal evaluations for Seattle, Spokane, Tacoma, Vancouver, Bellevue, Everett, Bellingham and Olympia

Washington’s civil rights agency says it plainly: under fair housing law, emotional support and comfort animals can be a reasonable accommodation, with no training requirement. The Washington Law Against Discrimination backs that up.

Washington ESA Laws at a Glance

Last reviewed November 2026 against official Washington and federal sources.

Washington has no ESA-specific statute. Housing rights come from RCW 49.60, and the Washington State Human Rights Commission (WSHRC) explains how they apply to ESAs.

Housing rights

RCW 49.60.222

Disability discrimination in real estate, including refusing reasonable accommodations, is unfair.

WSHRC guide

Service Animals and the WLAD

No training requirement in housing; ESAs and comfort animals included as accommodations.

Service animals

RCW 49.60.215

Public access for trained animals. Faking one is a civil infraction (RCW 49.60.214).

Where to file a complaint

WA State Human Rights Commission

Within 12 months of the harm, or with HUD within 1 year.

Housing is different from public places: Washington requires training for service animals in stores and restaurants, but WSHRC says fair housing law has no training requirement, so ESAs qualify as accommodations at home.

2026 federal change: since May 22, 2026, HUD has reviewed untrained ESAs case by case. The WLAD and WSHRC remain available to Washington renters, and a provider’s recommendation is the usual way to show need.

Building a Washington ESA Request

Following WSHRC’s guidance, a complete request shows:

  • That you have a disability
  • That you are asking for the animal as a reasonable accommodation
  • That the animal is necessary because of your disability
  • A note or recommendation from a licensed medical or mental health provider
  • License details, signature and date, with no diagnosis
  • A written request to waive no-pet rules and pet charges

Who may qualify: Washingtonians with a disability under the WLAD’s broad definition, such as anxiety, depression, PTSD or seasonal affective disorder, when an animal is necessary because of it.

Military families: housing at JBLM, Naval Base Kitsap, NAS Whidbey Island and Fairchild AFB follows installation pet rules, so check with the housing office too.

Washington ESA Letter FAQ

Are emotional support animals protected in Washington housing?

Yes. The Washington Law Against Discrimination (WLAD), RCW 49.60.222, bars disability discrimination in real estate transactions, including refusing reasonable accommodations. The Washington State Human Rights Commission's guide says that fair housing law has no training requirement for assistance animals and that "emotional support animals and comfort animals would be included as a reasonable accommodation."

Does Washington have an ESA letter law?

No. Washington has no statute on ESA documentation, no waiting period and no ESA misrepresentation offense. ESA requests are handled as reasonable accommodation requests under the WLAD and the federal Fair Housing Act.

What documentation does a Washington landlord expect?

According to WSHRC, the person must be able to show that the animal is necessary because of their disability, and this is usually done with a note or recommendation from a medical provider. A letter from a licensed provider who has evaluated you is the standard approach.

Can I get a Washington ESA letter through telehealth?

Yes. A video visit works in Washington as long as the clinician holds a Washington license (or is otherwise authorized to see Washington patients) and genuinely assesses your situation. That makes it practical for renters from the Olympic Peninsula to Walla Walla.

Can a Washington landlord charge a pet fee for my ESA?

WSHRC's guide says a service animal shouldn't carry a "pet fee" and that assistance animals should be allowed even under a no-pets rule. It doesn't spell out fees for ESAs, so include a sentence in your request asking the landlord to waive pet rent and pet deposits. Normal damage charges still apply.

How did HUD's 2026 change affect Washington?

Since HUD's May 22, 2026 policy change, untrained ESAs are reviewed case by case for federal enforcement. The WLAD is a separate state law, and WSHRC's guidance treats emotional support animals as a reasonable accommodation in housing, so Washington renters keep a state-law path.

Is it illegal to fake a service animal in Washington?

Yes, for public places. RCW 49.60.214 makes misrepresenting an animal as a service animal a civil infraction with a fine of up to $500. It doesn't create an ESA-specific offense, but never present an ESA as a service animal.

Can I take my ESA into stores or restaurants in Washington?

No. RCW 49.60.215 public-access rights cover trained service animals. WSHRC notes that the training requirement generally excludes emotional support animals outside housing.

Can I fly with my ESA from Seattle?

Not as an ESA. Since the DOT revised its air travel rules (14 CFR Part 382), carriers at Sea-Tac, Spokane, Paine Field and Bellingham can apply their pet policies to emotional support animals. A dog trained to perform tasks for a psychiatric disability is still treated as a service animal on board.

Where do I file a housing complaint in Washington?

WSHRC accepts housing complaints for twelve months after the alleged harm. HUD's federal window is also one year, and a private Fair Housing Act case can be filed in court for up to two years. Seattle residents can also contact the Seattle Office for Civil Rights.

Does an evaluation guarantee an ESA letter?

No. The clinician's judgment controls the outcome, and some Washington evaluations end with a different treatment suggestion.
