Emotional Support Animal West Virginia

West Virginia ESA Laws at a Glance

Last reviewed November 2026 against official West Virginia and federal sources.

In 2024 the Mountain State moved its Fair Housing Act to chapter 16B, article 18. The new article defines assistance animals and sets out documentation, fee and denial rules in unusual detail.

Definition

W. Va. Code § 16B-18-3(p)

Service, therapy or support animals under 150 lbs, trained or not, including emotional support.

Documentation

§ 16B-18-5(f)(10)(A)

From a professional treatment provider. No medical records or detailed impairment information.

Fees & denials

§ 16B-18-5(f)(10)(B)–(D)

No pet fees or deposits. Denial only on credible, individualized evidence about the animal.

Where to file a complaint

WV Human Rights Commission

Within 365 days, or with HUD within 1 year.

Evidence, not assumptions: a West Virginia landlord may deny an ESA only with credible evidence about the specific animal’s actual conduct. Breed, size (under 150 lbs) or general worries aren’t enough.

2026 federal change: since May 22, 2026, HUD has reviewed untrained ESAs case by case. West Virginia’s statute protects support animals “with or without specific training,” so the state rule stands on its own.

  • Shows a disability-related need for the animal
  • Shows the animal provides disability-related assistance or emotional support
  • Covers an animal weighing less than 150 pounds
  • Doesn’t include medical records or detailed impairment information

West Virginia ESA Letter FAQ

Does West Virginia have an emotional support animal law?

Yes. The West Virginia Fair Housing Act, recodified in 2024 at W. Va. Code chapter 16B, article 18, defines an "assistance animal" to include any service, therapy or support animal weighing less than 150 pounds, with or without training or certification, that provides emotional support alleviating one or more identified symptoms or effects of a disability.

What documentation can a West Virginia landlord ask for?

Under § 16B-18-5(f)(10)(A), documentation from a professional treatment provider showing a disability-related need for the animal. It is sufficient if it shows the animal provides disability-related assistance or emotional support. Landlords can't require medical records, access to your providers, or detailed or extensive information about your impairments.

Can a West Virginia landlord charge a pet deposit for my ESA?

No. Section 16B-18-5(f)(10)(D) says a request can't be conditioned on a fee, deposit or other terms that apply to residents with pets, and it can't be unreasonably denied or delayed.

When can a West Virginia landlord deny an ESA?

Only with credible evidence that the specific animal poses a direct threat to others' health or safety, or would cause substantial physical damage to others' property, that another reasonable accommodation can't eliminate or reduce. The decision must rest on an individualized assessment of the animal's actual conduct.

Is there a weight limit for ESAs in West Virginia?

Yes, by definition. To qualify as an assistance animal under § 16B-18-3, the animal must weigh less than 150 pounds.

Is there a waiting period for West Virginia ESA letters?

No. West Virginia sets no 30-day rule. Documentation should come from a professional treatment provider who has evaluated you.

Can I get a West Virginia ESA letter through telehealth?

Yes. The statute doesn't require an in-person visit, which helps in the state's rural and mountainous areas. Choose a treatment provider licensed to see West Virginia patients.

How did HUD's 2026 change affect West Virginia?

Since HUD's May 22, 2026 policy change, untrained ESAs are reviewed case by case for federal enforcement. West Virginia's own statute still defines assistance animals to include support animals "with or without specific training," so state protection continues.

Can I bring my ESA into stores or restaurants in West Virginia?

No. Public-access rights under the White Cane Law (§ 5-15-4) apply to service animals. Misrepresenting a service animal can bring a misdemeanor fine under § 5-15-9.

Can I fly with my ESA from Charleston or Huntington?

Under 14 CFR Part 382, airlines at Charleston Yeager (CRW), Huntington (HTS), Clarksburg (CKB) and Morgantown (MGW) may treat an ESA as a pet. A trained psychiatric service dog still flies as a service animal.

Where do I file a housing complaint in West Virginia?

With the West Virginia Human Rights Commission within 365 days, or with HUD within one year. A private Fair Housing Act lawsuit can be filed within two years.

Does an evaluation guarantee an ESA letter?

No. A licensed treatment provider decides after evaluating you and may suggest a different path.
