Wisconsin ESA Letter FAQ
Does Wisconsin have an emotional support animal law?
Yes. Wisconsin's Open Housing Law, Wis. Stat. § 106.50(2r)(br), protects people with a disability and a disability-related need for an emotional support animal. Landlords and condominium associations can't refuse to rent or sell, evict, require extra compensation as a condition of continued residence, or harass someone for keeping an ESA.
Who can write an ESA letter in Wisconsin?
A "licensed health professional" under § 106.50(1m)(mx): a physician, psychologist, social worker or other health professional who is licensed or certified in Wisconsin and acting within the scope of that license or certification. Documentation from a provider licensed only in another state doesn't meet the definition.
What documentation can a Wisconsin landlord request?
Reliable documentation from a licensed health professional that you have a disability and a disability-related need for the emotional support animal. Unlike the service animal rule, the ESA provision doesn't include an exception for disabilities that are readily apparent, so expect to provide a letter.
When can a Wisconsin landlord deny an ESA?
If you don't have a disability or disability-related need, or don't provide the requested documentation; if allowing the animal would impose an undue financial and administrative burden or fundamentally alter the housing provider's services; or if the specific animal poses a direct threat or would cause substantial physical damage that a reasonable accommodation can't reduce or eliminate.
Can a Wisconsin landlord charge extra for my ESA?
The statute bars requiring extra compensation as a condition of continued residence because of an ESA. You do accept liability for sanitation and for damage the animal causes to the premises.
What are the penalties for faking an ESA in Wisconsin?
A person who intentionally misrepresents having a disability or a need for an ESA to obtain housing must forfeit at least $500. A licensed health professional who misrepresents a patient's disability or need to help them obtain housing must also forfeit at least $500 (§ 106.50(2r)(br)5.–6.).
Is there a waiting period for Wisconsin ESA letters?
No. Wisconsin sets no 30-day relationship rule. The key requirement is that the professional is licensed or certified in Wisconsin.
Can I get a Wisconsin ESA letter through telehealth?
Yes, as long as the professional holds a Wisconsin license or certification and acts within its scope. Ask for a Wisconsin-licensed provider before you book.
How did HUD's 2026 change affect Wisconsin?
Since HUD's May 22, 2026 policy change, untrained ESAs are reviewed case by case for federal enforcement. Wisconsin's § 106.50(2r)(br) protects emotional support animals by name, so state protection continues, and the Equal Rights Division still takes complaints.
Can I take my ESA into stores or restaurants in Wisconsin?
No. Public-access rights under § 106.52(3)(am) belong to service animals. ESAs are protected in housing.
Can I fly with my ESA from Milwaukee or Madison?
Under 14 CFR Part 382, airlines at Milwaukee Mitchell (MKE), Madison (MSN), Green Bay (GRB) and Appleton (ATW) may treat an ESA as a pet. A task-trained psychiatric service dog still flies as a service animal.
Where do I file a housing complaint in Wisconsin?
With the Department of Workforce Development's Equal Rights Division, or in circuit court, within one year. You can also file with HUD within one year.
