Emotional Support Animal Wyoming

Wyoming ESA Laws at a Glance

Last reviewed November 2026 against official Wyoming and federal sources.

Wyoming’s rules sit in Title 35, Chapter 13, Article 2, which covers rights of persons with disabilities and links rental protection to the federal Fair Housing Act.

ESA definition

Wyo. Stat. § 35-13-205

Assistance animal includes one giving emotional support for identified symptoms of a disability.

Rental rights

§ 35-13-201(c)

No discrimination over an assistance animal; permitted as the FHA requires. Tenant pays damage.

Misrepresentation

§ 35-13-203(b)

Knowingly faking a service or assistance animal: misdemeanor, fine up to $750.

Where to file a complaint

U.S. Dept. of Housing & Urban Development

No state housing agency. HUD within 1 year; private suit within 2 years.

Federal law does a lot of the work: Wyoming says assistance animals shall be permitted in rentals “as required” by the federal Fair Housing Act, and the state has no housing agency of its own. That makes HUD’s May 22, 2026 shift to case-by-case review of untrained ESAs especially relevant here.

Still on your side: Wyoming’s statute names emotional support in its definition, bars rental discrimination over assistance animals, and the Fair Housing Act’s text is unchanged.

Preparing a Wyoming ESA Request

Because Wyoming follows the federal standard, include:

  • A letter from a licensed health or mental health provider
  • Confirmation of a disability that substantially limits a major life activity
  • How the animal alleviates identified symptoms or effects of that disability
  • License details, signature and date, without your diagnosis
  • A written request asking to waive no-pet rules and pet charges
  • Honest information only, since misrepresentation carries a $750 fine

Who may qualify: Wyomingites with a mental or physical impairment that substantially limits a major life activity, such as anxiety, depression or PTSD, when an animal eases identified symptoms.

Air Force families: housing at F.E. Warren AFB in Cheyenne follows installation pet rules, so check with the housing office too.

Wyoming ESA Letter FAQ

Does Wyoming have an emotional support animal law?

Yes. Wyo. Stat. § 35-13-205 defines an "assistance animal" to include an animal that provides emotional support alleviating one or more identified symptoms or effects of a person's disability. Under § 35-13-201(c), landlords may not discriminate in leasing or renting residential property because a tenant has an assistance animal, and such animals shall be permitted as required by the federal Fair Housing Act.

How does Wyoming's rule connect to federal law?

Section 35-13-201(c) ties the duty to permit assistance animals in rentals to the federal Fair Housing Act. That means the federal reasonable accommodation standard, 42 U.S.C. § 3604(f)(3)(B), shapes how Wyoming landlords evaluate ESA requests.

Is it a crime to fake an ESA in Wyoming?

Yes. Under § 35-13-203(b), knowingly and intentionally misrepresenting that an animal is a service animal or an assistance animal to obtain rights under the article is a misdemeanor punishable by a fine of up to $750. Because "assistance animal" includes ESAs, that covers false ESA claims.

What documentation can a Wyoming landlord ask for?

Wyoming's statute doesn't set a documentation format. Landlords generally follow federal fair housing practice: when the disability or need isn't obvious, they may ask for reliable information, usually a letter from a licensed health care provider, confirming a disability and a disability-related need.

Is there a waiting period for Wyoming ESA letters?

No. Wyoming sets no 30-day rule or provider list. The provider should still evaluate you genuinely before deciding.

Can I get a Wyoming ESA letter through telehealth?

Yes. Wyoming law doesn't require an in-person visit, which matters in a state with long distances between towns. Choose a provider licensed to treat patients in Wyoming.

Can a Wyoming landlord charge a pet deposit for my ESA?

Wyoming's statute doesn't address fees. Ask in writing that pet rent, fees and deposits be waived as part of your accommodation request. Under § 35-13-201(c), you are liable for any damage the animal causes to the premises or facilities.

How did HUD's 2026 change affect Wyoming?

Because Wyoming links its rental rule to the federal Fair Housing Act, HUD's May 22, 2026 decision to review untrained ESAs case by case matters here. The statute's text and Wyoming's own definition of assistance animal haven't changed, so a clear, well-supported request is especially important.

Can I take my ESA into stores or restaurants in Wyoming?

No. Section 35-13-201(b) allows service animals in public places under federal ADA regulations. ESAs are covered in rental housing, not public accommodations.

Can I fly with my ESA from Jackson Hole or Casper?

Under 14 CFR Part 382, airlines at Jackson Hole (JAC), Casper (CPR), Cheyenne (CYS) and Cody (COD) may treat an ESA as a pet. A trained psychiatric service dog still flies as a service animal.

Where do I file a housing complaint in Wyoming?

Wyoming has no state agency that investigates housing discrimination complaints, so file with HUD within one year. A private Fair Housing Act lawsuit can be filed within two years.

Does an evaluation guarantee an ESA letter?

No. A licensed provider decides after evaluating you and may not recommend an ESA.
