Pennsylvania ESA Laws at a Glance
In Pennsylvania, keeping an emotional support animal is a housing question, decided as a reasonable-accommodation request under the federal Fair Housing Act and 68 P.S. §§ 405.1–405.7. Since May 22, 2026, HUD reviews requests for untrained ESAs case by case, so Pennsylvania's own rules below matter.
PHRC released proposed assistance-animal guidance for comment (Oct 1-Nov 15, 2026); HB 2696 (2026) to amend the Act is pending in committee.

Pennsylvania ESA FAQ
Do I need to register my emotional support animal in Pennsylvania?
No. Neither federal nor Pennsylvania law requires or recognizes ESA registration; what counts is documentation that meets 68 P.S. § 405.3.
What does Pennsylvania require in an ESA letter?
If need isn't apparent, landlord or association may request documentation that is written, reliable, based on direct knowledge of the person's disability and need, and describes the need for the animal. (68 P.S. § 405.3).
Can my landlord in Pennsylvania refuse my ESA or charge a pet fee?
The landlord must consider it as a reasonable-accommodation request under 68 P.S. §§ 405.1–405.7 and the federal Fair Housing Act. Since May 2026, HUD no longer treats untrained ESAs as presumptively reasonable, so the outcome depends on your facts and Pennsylvania law. If it's granted, ask in writing whether pet fees or deposits are waived.
Is it illegal to misrepresent an emotional support animal in Pennsylvania?
Yes. Under 68 P.S. §§ 405.5, 405.6: Faking disability-related need: 3rd-degree misdemeanor; false animal papers/vests: summary offense, up to $1,000 fine.
Can I take my ESA into stores or restaurants in Pennsylvania?
No. 18 Pa.C.S. § 7325 and the ADA give access rights to trained service dogs only.
Can I fly with my ESA from Philadelphia (PHL)?
Airlines at Philadelphia (PHL) may treat an ESA as a pet under 14 CFR Part 382, so check your airline's pet rules before booking.
Where can I file a housing complaint in Pennsylvania?
With the Pennsylvania Human Relations Commission within 180 days of the incident, or with HUD within 1 year. Private Fair Housing Act lawsuits can be filed within 2 years.
