Virginia ESA Laws at a Glance

In Virginia, keeping an emotional support animal is a housing question, decided as a reasonable-accommodation request under the federal Fair Housing Act and Va. Code § 36-96.3:1. Since May 22, 2026, HUD reviews requests for untrained ESAs case by case, so Virginia's own rules below matter.

Virginia ESA FAQ

Do I need to register my emotional support animal in Virginia?

No. Neither federal nor Virginia law requires or recognizes ESA registration; what counts is documentation that meets Va. Code § 36-96.3:1(B)-(C).

What does Virginia require in an ESA letter?

Verification may come only from someone with a therapeutic relationship: a mental health provider, a state-licensed/certified provider, a free peer-support group, or a caregiver with actual knowledge of the disability. (Va. Code § 36-96.3:1(B)-(C)).

Can my landlord in Virginia refuse my ESA or charge a pet fee?

The landlord must consider it as a reasonable-accommodation request under Va. Code § 36-96.3:1 and the federal Fair Housing Act. Since May 2026, HUD no longer treats untrained ESAs as presumptively reasonable, so the outcome depends on your facts and Virginia law. If it's granted, ask in writing whether pet fees or deposits are waived.

Is it illegal to misrepresent an emotional support animal in Virginia?

Yes. Under Va. Code § 36-96.3:1(F); § 59.1-200: A provider who issues fraudulent documentation violates the Virginia Consumer Protection Act.

Can I take my ESA into stores or restaurants in Virginia?

No. Va. Code Ann. § 51.5-44(E) and the ADA give access rights to trained service dogs only.

Can I fly with my ESA from Washington Dulles (IAD)?

Airlines at Washington Dulles (IAD) may treat an ESA as a pet under 14 CFR Part 382, so check your airline's pet rules before booking.

Where can I file a housing complaint in Virginia?

With the Virginia Fair Housing Office (DPOR) within 1 year of the incident, or with HUD within 1 year. Private Fair Housing Act lawsuits can be filed within 2 years.
