Delaware Service Dog FAQ

Do I have to register my service dog in Delaware?

No. Neither the ADA nor Del. Code Ann. tit. 6, § 4504 requires registration, and businesses may not demand it.

What can a business in Delaware ask about my service dog?

Only two questions: is the dog required because of a disability, and what task is it trained to perform. No documents, demonstrations or pet fees.

Can I take a service dog in training into public places in Delaware?

Yes. The ADA doesn't cover dogs in training, but Delaware does under Del. Code Ann. tit. 6, § 4504(a)(3).

What happens if someone harms or interferes with my service dog in Delaware?

Delaware treats it as a specific offense under 16 Del. C. § 3056F: Interference: class B misd.; intentional injury: class A misd.; intentional killing: class D felony; theft: class E felony. Report it to local police, and keep vet bills and witness details.

Do I pay a dog license fee for my service dog in Delaware?

No dog license fee for a dog that qualifies as a seeing-eye, lead, or guide dog (a tag is still issued) (16 Del. C. § 3042F(e)). Your dog may still need to be licensed and vaccinated.

How do I file a complaint if I'm refused access in Delaware?

File with the Delaware Division of Human and Civil Rights within 180 days of the incident, or with the U.S. Department of Justice at ADA.gov.

Are service dogs allowed in rental housing in Delaware?

Generally yes. Trained service dogs are a reasonable accommodation under the federal Fair Housing Act and 6 Del. C. § 4601 et seq., so landlords should waive no-pet rules and pet fees, with narrow exceptions such as some small owner-occupied buildings.
