Online emotional support animal evaluations for Wilmington, Dover, Newark, Middletown and the beach towns of Sussex County
Delaware’s Fair Housing Act requires most landlords to make reasonable accommodations in their rules for tenants with disabilities, and that can include a no-pets policy.

Delaware ESA Laws at a Glance
Last reviewed November 2026 against official Delaware and federal sources.
Delaware relies on its Fair Housing Act (6 Del. C. ch. 46) rather than an ESA-specific statute. The Act’s accommodation duty, its limits and its complaint process are what matter for ESA owners.
Accommodation duty
Refusing reasonable accommodations in rules, policies, practices or services is disability discrimination.Small-landlord exemption
Doesn’t apply to buildings with up to 4 units where the owner lives in one of them.Fake ESA penalty
None for ESAs
SB 219 (2024) would have created one but did not pass.Where to file a complaint
Within 1 year (§ 4610); private lawsuit within 2 years (§ 4613).When a Delaware landlord can say no: under § 4603A(f), if the specific animal would be a direct threat to the health or safety of others, or would cause substantial physical damage to others’ property. A general dislike of pets isn’t enough.
2026 federal change: since May 22, 2026, HUD presumes accommodation requests reasonable only for individually trained animals and reviews untrained ESAs case by case. Delaware’s own accommodation duty, enforced by the Division of Human and Civil Rights, still applies.

Who May Qualify for a Delaware ESA Letter?
You need a disability, a mental or emotional condition that substantially limits a major life activity, and an animal that genuinely helps with it. People in Delaware often seek an evaluation for:
- Anxiety, including panic attacks
- Depression or bipolar disorder
- PTSD and trauma-related symptoms
- Other conditions that disrupt sleep, work, school or relationships
What landlords look for: a dated letter from a licensed provider, with their license type, number and state, stating that you have a disability and need the animal because of it. Your diagnosis doesn’t have to be disclosed.
An ID card or online registration is not an ESA letter.
Delaware ESA Letter FAQ
Does Delaware have an emotional support animal law?
Not a dedicated one. ESA requests in Delaware fall under the Delaware Fair Housing Act, which makes it discrimination to refuse reasonable accommodations in rules, policies, practices or services (6 Del. C. § 4603A(a)(2)), and under the federal Fair Housing Act. A 2024 bill (SB 219) that would have added ESA-specific rules did not pass.
Who can write an ESA letter in Delaware?
A licensed clinician who has evaluated you, such as a Delaware-licensed psychologist, licensed professional counselor of mental health, licensed clinical social worker, psychiatrist, nurse practitioner or physician. Delaware has no special ESA-letter statute, but providers treating someone in Delaware generally must be licensed there.
Does every Delaware landlord have to consider an ESA request?
Most do. Delaware's accommodation duty does not apply to rentals in a building with four or fewer units when the owner lives in one of them (6 Del. C. § 4607(e)), and a few other narrow exemptions exist. Apartment complexes, managed rentals and most single-family rentals are covered.
When can a Delaware landlord refuse my ESA?
Delaware law allows a refusal when the specific animal would be a direct threat to others' health or safety or would cause substantial physical damage (6 Del. C. § 4603A(f)), or when the request isn't supported. Since HUD's May 22, 2026 policy change, untrained ESAs are reviewed case by case at the federal level, so clear documentation matters.
Can a Delaware landlord charge a pet fee or deposit for an ESA?
Delaware has no ESA-specific fee statute. Ask your landlord to confirm in writing whether pet rent, pet deposits and breed or size limits are waived as part of the accommodation. You are still responsible for damage your animal causes.
What about summer beach rentals in Rehoboth, Dewey or Bethany?
Year-round leases are covered by fair housing law. Short vacation rentals are often handled differently, so check the listing's pet policy, and ask the owner or agency directly before you book a week at the beach.
Is it illegal to fake an emotional support animal in Delaware?
Delaware has no ESA-specific misrepresentation penalty. A false accommodation request can still be denied and may give a landlord grounds under your lease.
Can I take my ESA into stores or restaurants in Delaware?
No. Delaware's public-accommodations law (6 Del. C. ch. 45) and the ADA give access rights to service animals, not to emotional support animals.
Can I fly with my ESA from Delaware?
Most Delaware travelers fly from Philadelphia (PHL), Baltimore (BWI) or Wilmington (ILG). Under 14 CFR Part 382, airlines may treat an ESA as a pet, so check fees and carrier rules first. A task-trained psychiatric service dog still flies as a service animal.
Where do I file a housing complaint in Delaware?
With the Delaware Division of Human and Civil Rights within one year of the incident (6 Del. C. § 4610), or with HUD within one year. You can also file a private lawsuit within two years (§ 4613).
Does an evaluation guarantee an ESA letter?
No. You're paying for a professional assessment. A letter is written only if the provider concludes an emotional support animal is appropriate for you.
