ESA Letter in Georgia From a Licensed Provider

Online emotional support animal evaluations for Atlanta, Savannah, Augusta, Columbus, Macon, Athens and communities across Georgia

Under the Georgia Fair Housing Act, landlords and associations must make reasonable accommodations in their rules for people with disabilities, and a no-pets rule is one of those rules.

To ask for one, you need an ESA letter from a licensed provider. Start online and the provider decides whether it’s right for you.

Georgia ESA Laws at a Glance

Last reviewed November 2026 against official Georgia and federal sources.

Georgia hasn’t written an ESA statute. What protects ESA owners is the Georgia Fair Housing Act (O.C.G.A. § 8-3-200 et seq.), enforced by the Georgia Commission on Equal Opportunity, alongside the federal Fair Housing Act.

Accommodation duty

O.C.G.A. § 8-3-202(a)(7)(B)(ii)

Refusing reasonable accommodations in rules, policies, practices or services is unlawful disability discrimination.

ESA letter rules

No Georgia-specific rule

If your need isn’t apparent, a landlord can ask for documentation from a licensed provider.

Fake ESA penalty

None for ESAs

Georgia has no ESA misrepresentation law. A false request can still be denied.

Where to file a complaint

Georgia Commission on Equal Opportunity

Fair Housing Division, within 1 year of the incident, or HUD within 1 year.

The direct-threat exception: Georgia’s statute doesn’t require housing someone whose tenancy would directly threaten others’ health or safety or cause substantial physical damage to others’ property (§ 8-3-202(d)). The question is generally about your specific animal, not stereotypes about its breed.

2026 federal change: since May 22, 2026, HUD presumes accommodation requests reasonable only for individually trained animals and reviews untrained ESAs case by case. Georgia’s Fair Housing Act still requires reasonable accommodations, and GCEO still takes complaints.

Flights

Who May Qualify for a Georgia ESA Letter?

Georgia law protects people with a disability, including a mental impairment that substantially limits a major life activity. People commonly seek an evaluation for:

  • Anxiety and panic symptoms
  • Depression
  • PTSD, including service-connected PTSD in military families
  • Other conditions that interfere with sleep, work, school or relationships

Your letter should come from a licensed provider, list their license type, number and state, carry a date and signature, and confirm a disability-related need for the animal, without revealing your diagnosis.

An online registration or ID card is not an ESA letter.

Georgia ESA Letter FAQ

Does Georgia have an emotional support animal law?

No ESA-specific statute. The Georgia Fair Housing Act makes it unlawful to refuse reasonable accommodations in rules, policies, practices or services when a person with a disability needs them to use and enjoy a home (O.C.G.A. § 8-3-202(a)(7)(B)(ii)). Together with the federal Fair Housing Act, that is the basis for an ESA request in Georgia.

Who can write an ESA letter in Georgia?

A licensed provider who has evaluated you: for example a Georgia-licensed psychologist, licensed professional counselor, licensed clinical social worker, psychiatrist, nurse practitioner or physician. Georgia sets no ESA-letter format, but a provider treating someone in Georgia generally must hold a Georgia license.

When can a Georgia landlord refuse my ESA?

Georgia's statute does not require housing a person whose tenancy would be a direct threat to others' health or safety or would cause substantial physical damage to others' property (§ 8-3-202(d)). Requests can also be turned down when the need isn't supported. Since HUD's May 22, 2026 policy change, untrained ESAs are reviewed case by case at the federal level.

Do Atlanta-area HOAs have to consider ESA requests?

Homeowners' associations that enforce pet, breed or size rules are generally subject to fair housing law. Send your request and letter to the association's board or management company in writing and keep a copy.

What about base housing at Fort Stewart, Fort Moore or Robins AFB?

Military and privatized base housing have their own animal policies and request procedures. Contact the installation housing office or the housing company early and bring your provider's letter.

Can a Georgia landlord charge pet rent or a pet deposit for an ESA?

Georgia has no statute on fees for ESAs. Ask your landlord to confirm in writing whether pet rent, pet deposits and breed or weight limits will be waived as part of your accommodation. Damage your animal causes is still your responsibility.

Is it illegal to fake an emotional support animal in Georgia?

Georgia has no ESA-specific misrepresentation penalty. A request built on false statements can still be denied and may put your lease at risk.

Can I take my ESA into stores or restaurants in Georgia?

No. Public-access rights under the ADA and O.C.G.A. § 30-4-2, which Georgia rewrote effective July 1, 2026, belong to service animals, not ESAs.

Can I fly with my ESA from Atlanta Hartsfield-Jackson?

Under 14 CFR Part 382, airlines at ATL, Savannah (SAV) and other Georgia airports may treat an ESA as a pet. Check pet fees and carrier rules before you book. A task-trained psychiatric service dog still flies as a service animal.

Where do I file a housing complaint in Georgia?

With the Georgia Commission on Equal Opportunity's Fair Housing Division within one year of the incident, or with HUD within one year. A private Fair Housing Act lawsuit can be filed within two years.

Does an evaluation guarantee an ESA letter?

No. The evaluation is a professional assessment. The provider writes a letter only if they decide an emotional support animal is appropriate for you.
