Kansas ESA Letter for Housing

Emotional support animal evaluations for Wichita, Overland Park, Kansas City, Olathe, Topeka, Lawrence and Manhattan

Kansas has no separate ESA statute. Your housing rights come from K.S.A. 44-1016, which requires reasonable accommodations in rules and policies for tenants with disabilities, working alongside the federal Fair Housing Act.

Kansas ESA Laws at a Glance

Last reviewed November 2026 against official Kansas and federal sources.

Kansas regulates the subject indirectly. The housing chapter of the Kansas Act Against Discrimination protects tenants with disabilities, while the state’s assistance-dog statutes deal only with trained dogs in public places.

Housing rights

K.S.A. 44-1016(h)

Refusing reasonable accommodations in rules, policies, practices or services for a person with a disability is unlawful.

Letter rules

No Kansas statute

No mandatory format, waiting period or fee disclosure. Federal fair housing guidance fills the gap.

Public places

K.S.A. 39-1108

Covers assistance dogs only. Faking a service animal is a Class A nonperson misdemeanor (39-1112).

Where to file a complaint

Kansas Human Rights Commission

Within one year under K.S.A. 44-1019, or with HUD within 1 year.

Why the letter carries more weight in Kansas: with no state ESA statute spelling out what landlords may request, Kansas property managers usually follow federal fair housing practice. A clear letter from a licensed clinician is what that practice treats as reliable documentation.

2026 federal change: since May 22, 2026, HUD has reviewed untrained ESAs case by case. The Fair Housing Act’s text hasn’t changed, and K.S.A. 44-1016 still requires reasonable accommodations, so a specific, well-supported request matters more than ever.

Where a Kansas ESA Letter Helps — and Where It Doesn’t

Rentals & HOAs

Yes. K.S.A. 44-1016 and the FHA require landlords to consider adjusting pet policies.

KU, K-State & Wichita State

Usually. Residence halls route ESA requests through campus disability offices, so apply well before move-in.

Flights

No. Carriers at ICT, MCI and MHK may treat an ESA as a pet.

Stores & Restaurants

No. Kansas public-access law (39-1108) applies to assistance dogs, not ESAs.

What a Strong Kansas ESA Letter Shows

Kansas doesn’t prescribe a format, so landlords look to federal fair housing practice. A dependable letter:

  • Is written on the provider’s letterhead and signed and dated
  • Lists the provider’s license type, number and issuing state
  • Confirms you have a disability without disclosing the diagnosis
  • Explains how the animal relates to that disability
  • Identifies the animal, or each animal if there is more than one
  • Gives contact details so the landlord can verify it

Who may qualify: Kansans living with a mental or emotional disability, for example anxiety, depression, PTSD or panic disorder, when the animal eases symptoms that limit daily life.

Military families: housing at Fort Riley, Fort Leavenworth and McConnell AFB follows installation policies, so check with the housing office as well.

Kansas ESA Letter FAQ

Does Kansas have an emotional support animal law?

Not a dedicated one. Kansas has no statute that defines ESAs, sets letter requirements or penalizes fake ESA documents; several assistance-animal housing bills have been introduced in the Legislature without becoming law. Instead, ESA requests in Kansas rest on the disability provisions of the Kansas Act Against Discrimination and the federal Fair Housing Act.

What does Kansas housing law say about disability accommodations?

K.S.A. 44-1016(h) makes it unlawful to refuse reasonable accommodations in rules, policies, practices or services when they may be necessary to give a person with a disability equal opportunity to use and enjoy a dwelling. A no-pet rule is the kind of policy an ESA request asks a landlord to adjust.

Is there a 30-day rule or special letter format in Kansas?

No. Unlike neighbors such as Iowa, Kansas law sets no waiting period and no mandatory letter contents. A reliable letter still explains, without naming your diagnosis, that you have a disability and how the animal relates to it, and it comes from a provider licensed to practice where you live.

Can I get a Kansas ESA letter through telehealth?

Yes. Kansas has no ESA-specific restriction on telehealth evaluations. The provider should hold an active license that lets them treat patients located in Kansas, and the evaluation should be a genuine clinical assessment rather than a purchased certificate.

Do ESA registrations or certificates count in Kansas?

Not on their own. No Kansas or federal agency runs an ESA registry. What a landlord may consider is reliable information about disability and need, which typically means a letter from a licensed health professional.

Can a Kansas landlord deny my ESA or charge pet rent?

A landlord may refuse an accommodation that would impose an undue financial and administrative burden, fundamentally alter its operations, or involve an animal that poses a direct threat or would cause substantial damage that can't be reduced. Kansas law doesn't address pet fees for assistance animals, so ask in writing whether they'll be waived; you remain responsible for any damage your animal causes. Since HUD's May 22, 2026 policy change, untrained ESAs are reviewed case by case, so put your request and the response in writing.

Does Kansas service animal law cover ESAs?

No. K.S.A. 39-1108 gives public-access rights to people with assistance dogs, and K.S.A. 39-1112 makes misrepresenting a service animal a Class A nonperson misdemeanor. ESAs are not assistance dogs under these sections, so an ESA letter does not open stores or restaurants.

Can I fly with my ESA from Wichita or Kansas City?

Under 14 CFR Part 382, airlines at Wichita (ICT), Kansas City International (MCI) and Manhattan (MHK) may treat an ESA as a pet. A dog trained to perform tasks for a psychiatric disability can still fly as a service animal.

Where do I file a housing complaint in Kansas?

With the Kansas Human Rights Commission within one year of the alleged discriminatory housing practice (K.S.A. 44-1019), or with HUD within one year. A private Fair Housing Act lawsuit can be filed within two years.

Does an evaluation guarantee a Kansas ESA letter?

No. A licensed provider decides after the evaluation, and may decide an ESA isn't the right fit for you.
