Animal guidance (PHRC)

ESAs can be a reasonable accommodation in housing. Online certificates aren’t needed.

Penalties

68 P.S. §§ 405.5–405.6

False need: 3rd-degree misdemeanor. False papers or vests: summary offense, up to $1,000.

Where to file a complaint

PA Human Relations Commission

Within 180 days, or with HUD within 1 year.

Guidance update in progress: PHRC released proposed updated animal guidance on October 1, 2026, with comments open through November 15, 2026. The current guidance still treats ESAs as a reasonable accommodation in housing.

2026 federal change: since May 22, 2026, HUD has reviewed untrained ESAs case by case. The PHRA is unchanged, so Pennsylvania renters keep a state-law basis for ESA requests.

Pennsylvania ESA Documentation Checklist

To meet Act 118 and PHRC expectations, your documentation should be:

  • Written, and from a licensed professional
  • Based on direct knowledge of your disability and need
  • Clear about why you need the animal
  • Separate for each animal’s disability-related function, if you have more than one
  • Free of your diagnosis and medical records
  • Never paired with a service vest or sign on an ESA

Who may qualify: Pennsylvanians with a mental or emotional disability, such as anxiety, depression, PTSD or panic disorder, when an animal helps with disability-related symptoms.

For landlords: PHRC says any denial for direct threat or damage needs reliable, objective evidence and can’t be based on generalizations about a type or breed.

Pennsylvania ESA Letter FAQ

Does Pennsylvania have an emotional support animal law?

Yes. The Assistance and Service Animal Integrity Act (Act 118 of 2018, 68 P.S. §§ 405.1–405.7) governs documentation for assistance and service animals in housing and creates offenses for misrepresentation. Housing rights themselves come from the Pennsylvania Human Relations Act (PHRA) and the federal Fair Housing Act.

Does the PHRA protect ESAs in housing?

Yes. The Pennsylvania Human Relations Commission's guidance says that under the PHRA and the Fair Housing Act, people with disabilities can request a reasonable accommodation to keep an emotional support animal in their home, even where a no-pets rule exists.

What documentation can a Pennsylvania landlord or association request?

When the disability or need isn't readily apparent, Act 118 lets a landlord or association request documentation that is written, reliable, based on direct knowledge of your disability and need, and describes the need for the animal. PHRC guidance lists doctors, psychiatrists, licensed social workers, therapists and other licensed professionals with direct knowledge as appropriate sources.

Do online ESA certificates count in Pennsylvania?

No. PHRC guidance warns about websites that sell certificates, registrations or licenses after a short interview or survey, and says these "are not necessary under current Commonwealth law." Certifications aren't required for a housing provider to approve an ESA.

What are the penalties for faking an ESA in Pennsylvania?

Intentionally misrepresenting a disability-related need, or making materially false statements to get documentation, is a misdemeanor of the third degree (68 P.S. § 405.5). Creating or giving someone a false document, or fitting an animal with a harness, collar, vest or sign suggesting it is an assistance or service animal, is a summary offense with a fine of up to $1,000 (§ 405.6).

Is there a waiting period for Pennsylvania ESA letters?

No. Pennsylvania sets no 30-day relationship rule. What matters is that the provider has direct knowledge of your disability and need.

Can I get a Pennsylvania ESA letter through telehealth?

Yes. Pennsylvania law doesn't bar telehealth evaluations. Use a licensed provider who can treat Pennsylvania patients and who gains direct knowledge of your disability and need, not a quick online questionnaire.

Can a Pennsylvania landlord charge pet fees for my ESA?

Pennsylvania guidance clearly bars pet rent, pet deposits and pet security for service animals. For ESAs, ask in writing for those charges to be waived as part of your accommodation. You can be held responsible for damage.

Is Pennsylvania changing its ESA guidance?

PHRC released updated proposed Assistance, Emotional Support, and Service Animal Guidance on October 1, 2026, with public comment open through November 15, 2026. A separate bill, HB 2696, would amend Act 118 and was pending in committee as of this review. Since HUD's May 22, 2026 policy change, federal enforcement for untrained ESAs is case by case, but the PHRA has not changed.

Can I take my ESA into stores or restaurants in Pennsylvania?

No. PHRC guidance says public accommodations are not required to admit emotional support animals. Public-access rights belong to service animals.

Can I fly with my ESA from Philadelphia or Pittsburgh?

Under 14 CFR Part 382, airlines at Philadelphia (PHL), Pittsburgh (PIT), Lehigh Valley (ABE) and Harrisburg (MDT) may treat an ESA as a pet. A task-trained psychiatric service dog still flies as a service animal.

Where do I file a housing complaint in Pennsylvania?

With the Pennsylvania Human Relations Commission within 180 days of the alleged discrimination, or with HUD within one year. A private Fair Housing Act lawsuit can be filed within two years.
