Emotional support animal evaluations for Virginia Beach, Richmond, Norfolk, Chesapeake, Arlington, Alexandria, Roanoke and Charlottesville
Virginia’s Fair Housing Law gives tenants with assistance animals clear rules. Under § 36-96.3:1, approved animals come with no pet fee, deposit or extra rent, and documentation must come from someone in a good-faith therapeutic relationship with you.
Do a free pre-screening, then meet a licensed mental health provider by video to see whether an ESA fits your care.

Fraudulent documentation is a Virginia Consumer Protection Act violation.Where to file a complaint
Within 1 year, or with HUD within 1 year.Verification limits work in your favor: if your disability or need is obvious or already known, a Virginia landlord can’t ask for more proof of the disability. If only the need is unclear, they can ask about the need alone.
2026 federal change: since May 22, 2026, HUD has reviewed untrained ESAs case by case. Virginia’s § 36-96.3:1 still sets the state process and the no-fee rule, so documentation from a genuine therapeutic relationship remains key.

Virginia “Therapeutic Relationship” Checklist
For documentation under § 36-96.3:1(C) and (E), make sure it:
- Comes from someone providing good-faith care, not just selling a letter
- Is from a mental health service provider or a state-licensed or certified entity
- Shows reliable evidence of your disability and disability-related need
- Includes license details, signature and date
- Leaves out your diagnosis and medical records
- Is accurate, since fraudulent documentation violates the Consumer Protection Act
Who may qualify: Virginians with a mental or emotional disability, such as anxiety, depression, PTSD or panic disorder, when an animal helps with disability-related needs.
Military families: housing at Naval Station Norfolk, Fort Belvoir, Quantico and Joint Base Langley-Eustis follows installation pet rules, so check with the housing office too.
Virginia ESA Letter FAQ
Does Virginia have an emotional support animal law?
Yes. Va. Code § 36-96.3:1, part of the Virginia Fair Housing Law, covers assistance animals in dwellings. It sets limits on verification, says who may provide documentation, bars pet fees for approved animals, and makes fraudulent documentation from providers a Virginia Consumer Protection Act violation.
Can a Virginia landlord charge a pet fee or deposit for my ESA?
No. Under § 36-96.3:1(A), a resident with an approved assistance animal is not charged a pet fee, deposit or extra rent for the animal. You're liable for physical damage to the dwelling if a pet-owning resident would be.
Who can write a Virginia ESA letter?
Documentation may come from anyone with whom you have or had a "therapeutic relationship," meaning good-faith medical, program or personal care services from: a mental health service provider under § 54.1-2400.1; a person or entity with a valid, unrestricted state license, certification or registration to serve people with disabilities; a no-fee peer support group member with actual knowledge of your disability; or a caregiver, reliable third party or government entity with actual knowledge.
When can a Virginia landlord ask for verification?
If your disability or need is obvious or already known, the landlord can't ask for more verification of the disability. If the disability is known but the disability-related need isn't apparent, the landlord may ask for verification of the need only.
What happens to providers who issue fake ESA letters in Virginia?
Under § 36-96.3:1(F), a provider who gives fraudulent supporting documentation to show a disability commits a prohibited practice under the Virginia Consumer Protection Act (§ 59.1-200). Virginia's rule targets documentation providers, not just tenants.
Is there a waiting period for Virginia ESA letters?
No. Virginia sets no 30-day rule. The key is a good-faith therapeutic relationship in which the provider actually delivers care.
Can I get a Virginia ESA letter through telehealth?
Yes. Section 36-96.3:1 doesn't require in-person care. Choose a mental health provider licensed to treat patients in Virginia who provides genuine services in good faith.
How did HUD's 2026 change affect Virginia?
Since HUD's May 22, 2026 policy change, untrained ESAs are reviewed case by case for federal enforcement. Virginia's § 36-96.3:1 still governs assistance animal requests, including the ban on pet fees for approved animals, and Virginia's Fair Housing Office still takes complaints.
Can I take my ESA into stores or restaurants in Virginia?
No. Public-access rights under Va. Code § 51.5-44 belong to people with trained service dogs. Misrepresenting a dog as a service dog is a Class 4 misdemeanor under § 51.5-44.1.
Can I fly with my ESA from Dulles, Reagan or Richmond?
Under 14 CFR Part 382, airlines at Washington Dulles (IAD), Reagan National (DCA), Richmond (RIC) and Norfolk (ORF) may treat an ESA as a pet. A task-trained psychiatric service dog still flies as a service animal.
Where do I file a housing complaint in Virginia?
With the Virginia Fair Housing Office at the Department of Professional and Occupational Regulation (DPOR) within one year, or with HUD within one year. A private Fair Housing Act lawsuit can be filed within two years.
Does an evaluation guarantee an ESA letter?
No. A licensed provider decides after evaluating you and may recommend another approach.
