Maine ESA FAQ
Do I need to register my emotional support animal in Maine?
No. Neither federal nor Maine law requires or recognizes ESA registration; what counts is documentation that meets 5 M.R.S. § 4553(1-H)(A).
What does Maine require in an ESA letter?
An assistance animal must be determined necessary by a doctor, psychologist, PA, nurse practitioner, licensed social worker, licensed professional counselor, or other licensed provider who understands your need. (5 M.R.S. § 4553(1-H)(A)).
Can my landlord in Maine refuse my ESA or charge a pet fee?
The landlord must consider it as a reasonable-accommodation request under 5 M.R.S. § 4582-A and the federal Fair Housing Act. Since May 2026, HUD no longer treats untrained ESAs as presumptively reasonable, so the outcome depends on your facts and Maine law. Maine bars extra pet fees or deposits for assistance animals, though you remain liable for damage.
Is it illegal to misrepresent an emotional support animal in Maine?
Yes. Under 17 M.R.S. § 1314-A: Civil violation; fine up to $1,000 per occurrence for knowingly misrepresenting an assistance animal or faking papers.
Can I take my ESA into stores or restaurants in Maine?
No. Me. Rev. Stat. tit. 17, § 1312 and the ADA give access rights to trained service dogs only.
Can I fly with my ESA from Portland (PWM)?
Airlines at Portland (PWM) may treat an ESA as a pet under 14 CFR Part 382, so check your airline's pet rules before booking.
Where can I file a housing complaint in Maine?
With the Maine Human Rights Commission within 300 days of the incident, or with HUD within 1 year. Private Fair Housing Act lawsuits can be filed within 2 years.
