ESA Letter in Colorado That Follows State Rules

Emotional support animal evaluations for renters in Denver, Colorado Springs, Aurora, Fort Collins, Boulder and mountain towns

Colorado is strict about who can write an ESA letter. Therapists and nurses must have met you in person; physicians may see you in person or by telemedicine. Every provider must know you and your condition well enough to make the call.

Start with a free pre-screening. When you book, ask for a Colorado option: an in-person visit with a therapist, or a telemedicine visit with a physician.

Pre-screening does not guarantee approval. In Colorado, a therapist or nurse may only write an ESA housing finding after meeting you in person.

Colorado ESA Laws at a Glance

Last reviewed November 2026 against official Colorado and federal sources.

Colorado regulates ESA letters through its professional practice acts, so the rules depend on whether your provider is a therapist, nurse or physician. Housing protection comes from the Colorado Anti-Discrimination Act and the federal Fair Housing Act.

Housing law

C.R.S. § 24-34-502

Colorado Anti-Discrimination Act: bars housing discrimination based on disability, including refusing reasonable accommodations.

ESA letter rules

C.R.S. § 12-245-229

Therapists and nurses: met you in person. Physicians: in person or telemedicine. All: familiar with you and qualified.

Fake ESA penalty

C.R.S. § 18-13-107.3

Civil infraction after a prior warning: $25, then $50–$200, then $100–$500.

Where to file a complaint

Colorado Civil Rights Division

File within 1 year of the incident, or with HUD within 1 year.

Why “instant online ESA letters” don’t work in Colorado: Colorado’s licensing agency says ESA recommendations require a bona fide provider-patient relationship, and therapists and nurses must have met the patient in person. A letter from a therapist you’ve only met over video, or from a website with no real evaluation, doesn’t meet that standard.

2026 federal change: since May 22, 2026, HUD reviews untrained ESAs case by case. A Colorado-compliant written finding is also a defense if anyone accuses you of misrepresenting your animal.

No. Airlines at DEN, COS and mountain airports may treat an ESA as a pet under their own rules and fees.

Stores, Trails & Restaurants

No. C.R.S. § 24-34-803 and the ADA give public access to trained service animals only.

Who Can Write a Colorado ESA Letter?

Colorado lets these licensees make a written finding for a housing assistance animal, each under its own practice act:

  • Mental health professionals (psychologists, LPCs, LCSWs, LMFTs): after meeting you in person — § 12-245-229
  • Physicians: after meeting you in person or by telemedicine — § 12-240-144
  • Nurses: after meeting you in person — § 12-255-133
  • All of them: sufficiently familiar with you and your disability, and qualified to decide

Who may qualify: Coloradans with a mental or emotional disability, such as anxiety, depression or PTSD, that substantially limits daily life, when the animal relieves symptoms of that condition.

Registrations, vests and ID cards are not written findings and don’t satisfy Colorado’s rules on their own.

Colorado ESA Letter FAQ

Does Colorado have its own ESA letter law?

Yes. Colorado's practice acts for mental health professionals (C.R.S. § 12-245-229), physicians (§ 12-240-144) and nurses (§ 12-255-133) set conditions before a licensee may make a written finding that you need an assistance animal for housing. Colorado also penalizes misrepresenting an assistance animal in housing (§ 18-13-107.3).

Can I get a Colorado ESA letter through an online video visit?

It depends on who writes it. Colorado mental health professionals and nurses may not make the finding unless they have met you in person. Physicians may make it after meeting you in person or by telemedicine. A letter from a therapist you have only seen by video does not meet Colorado's rule.

What else must a Colorado provider do before writing an ESA letter?

They must be sufficiently familiar with you and your disability, and be legally and professionally qualified to make the determination. Colorado's licensing agency also says a bona fide provider-patient relationship should exist before an ESA recommendation is issued. The provider can also find that there isn't enough information to decide.

Can a Colorado landlord refuse my emotional support animal?

Requests are reasonable-accommodation requests under the federal Fair Housing Act and the Colorado Anti-Discrimination Act. A landlord may refuse when the animal poses a direct threat or would cause substantial damage that can't be reduced. Since HUD's May 2026 policy change, untrained ESAs are reviewed case by case at the federal level, so a letter that follows Colorado's rules carries more weight.

Can a Colorado landlord charge a pet deposit for an ESA?

Colorado statutes don't set an ESA-specific fee rule. Ask your landlord or HOA to confirm in writing whether pet deposits, pet rent and breed or weight limits will be waived for your accommodation, and remember you are responsible for any damage.

Is it illegal to fake an emotional support animal in Colorado?

Yes. Knowingly misrepresenting an animal as an assistance animal to get housing is a civil infraction under § 18-13-107.3, but only after a prior warning: $25 for a first offense, $50 to $200 for a second, and $100 to $500 after that. A written finding from a qualified Colorado provider is a defense to the charge.

Can I take my ESA into stores or restaurants in Colorado?

No. Colorado's public-access law (C.R.S. § 24-34-803) and the ADA cover trained service animals. Faking a service animal in public is a separate offense under § 18-13-107.7.

Can I bring my ESA to a ski-town or seasonal rental?

Long-term rentals follow fair housing law, so you can request an accommodation with your letter. Short vacation rentals are often treated differently, so check the listing's pet policy before you book in Vail, Breckenridge, Aspen or other mountain towns.

Can I fly with my ESA from Denver International?

Airlines may treat an ESA as a pet under 14 CFR Part 382, so check fees, carrier size and cabin limits before booking from DEN, COS or mountain airports like Eagle and Aspen. A task-trained psychiatric service dog still flies as a service animal.

Where do I file a housing complaint in Colorado?

With the Colorado Civil Rights Division within one year of the incident, or with HUD within one year. A private Fair Housing Act lawsuit can be filed within two years.

Does an evaluation guarantee an ESA letter?

No. A Colorado provider can find that you qualify, that you don't, or that there isn't enough information yet. A letter is written only when the provider concludes an ESA is appropriate.
