Emotional support animal evaluations for Oklahoma City, Tulsa, Norman, Broken Arrow, Edmond, Lawton and Stillwater

Oklahoma names emotional support animals in 41 O.S. § 113.2, but it also lets landlords verify letters and presumes purchased documentation is fraudulent. That makes a genuine clinical relationship more important here than in most states.

Take a free pre-screening and talk with a licensed provider about whether an ESA, and what kind of documentation, fits your situation.

Oklahoma ESA Laws at a Glance

Last reviewed November 2026 against official Oklahoma and federal sources.

Oklahoma has a dedicated assistance animal section in its landlord-tenant title, plus the Oklahoma Discrimination in Housing Act, enforced by the Attorney General’s Office of Civil Rights Enforcement.

Documentation

41 O.S. § 113.2(B)

Verifies an FHA disability, describes the accommodation and links the two. Landlords may verify it.

Purchase presumption

41 O.S. § 113.2(B)

Documentation “acquired through purchase or exchange of funds for goods and services” is presumed fraudulent.

Housing rights

25 O.S. § 1452(A)(16)(b)

Refusing reasonable accommodations in rules, policies, practices or services is discrimination.

Where to file a complaint

OK Attorney General — Civil Rights

Within 1 year of the last unlawful practice, or with HUD within 1 year.

Read this before you buy any Oklahoma ESA letter: because § 113.2 presumes purchased documentation is fraudulent, a letter that looks like an online product can be questioned. The safest documentation comes from a provider who treats you over time and can confirm your need if your landlord calls.

2026 federal change: since May 22, 2026, HUD has reviewed untrained ESAs case by case. Oklahoma’s statute still recognizes emotional support animals, but between the federal shift and the state presumption, documentation quality matters a great deal here.

How an Oklahoma ESA Evaluation Works

Built around genuine care, not a quick document.

  1. 1

    Pre-Screening

Describe your symptoms, your animal and your Oklahoma housing situation.

  2. 2

    Clinical Evaluation

Ask for an Oklahoma-licensed provider who can see you for ongoing care.

  3. 3

    Provider’s Decision

They decide whether an ESA addresses identified symptoms of your disability. Nothing automatic.

  4. 4

    Verifiable Documentation

If approved, your landlord can confirm the letter directly with the provider.

What Oklahoma Documentation Should Show

To meet § 113.2(B) and hold up to verification:

  • That you have a disability as defined by the federal Fair Housing Act
  • A description of the accommodation needed (keeping the ESA)
  • The link between your disability and that accommodation
  • A licensed provider your landlord can contact to verify it
  • Evidence of genuine clinical care, not just a purchase
  • Signature, date and license details

Who may qualify: Oklahomans with a disability, such as anxiety, depression or PTSD, when an animal provides emotional support for identified symptoms.

Already in treatment? If you see a counselor, therapist or doctor in Oklahoma, ask them first. A letter from your existing provider is the strongest option under § 113.2.

Oklahoma ESA Letter FAQ

Does Oklahoma have an emotional support animal law?

Yes. 41 O.S. § 113.2, in effect since November 1, 2018, defines an "assistance animal" to include an animal that provides emotional support for one or more identified symptoms or effects of a disability. It sets documentation rules for housing requests, protects landlords from liability for permitted animals, and gives landlords remedies for fraud.

What documentation can an Oklahoma landlord ask for?

Unless the disability or need is readily apparent, reliable supporting documentation that verifies you have a disability as defined by the federal Fair Housing Act, describes the accommodation you need, and shows the link between the disability and the request. The landlord may independently verify that the documentation is authentic.

What is Oklahoma's "purchased documentation" presumption?

Section 113.2(B) says documentation "acquired through purchase or exchange of funds for goods and services" shall be presumed to be fraudulent. The statute doesn't define the phrase further. A presumption can be rebutted, and the rule may be in tension with federal fair housing law, but it means Oklahoma landlords may question letters that look like a product bought online.

How can I make my Oklahoma ESA documentation more reliable?

The strongest documentation comes from a licensed provider who treats you as part of ongoing care, can speak to your disability and need, and can be reached by the landlord to confirm authenticity. If you use an online evaluation, choose one that involves a genuine clinical assessment and expect that your landlord may verify it.

Can I get an Oklahoma ESA evaluation through telehealth?

Oklahoma law doesn't prohibit telehealth evaluations. Because of the § 113.2 presumption, though, an ongoing treatment relationship with an Oklahoma-licensed provider, by video or in person, is better documentation than a one-time letter.

What happens if someone fakes an ESA in Oklahoma?

If a person knowingly makes a false disability claim or knowingly provides fraudulent documentation, the landlord may use noncompliance remedies under the Residential Landlord and Tenant Act. A landlord who wins an eviction case may recover court costs, fees and up to $1,000 in damages.

Can an Oklahoma landlord charge a pet fee for my ESA?

Section 113.2 doesn't address fees. Ask in writing for pet fees, pet rent and deposits to be waived as part of the accommodation. You remain responsible for damage your animal causes.

How did HUD's 2026 change affect Oklahoma?

Since HUD's May 22, 2026 policy change, untrained ESAs are reviewed case by case for federal enforcement. Oklahoma's § 113.2 still names emotional support animals, and the Oklahoma Discrimination in Housing Act, 25 O.S. § 1452(A)(16)(b), still treats refusing reasonable accommodations as discrimination.

Can I bring my ESA into stores or restaurants in Oklahoma?

No. Oklahoma's public-access law (7 O.S. § 19.1) covers service animals. Misrepresenting an animal as a service animal is a misdemeanor.

Can I fly with my ESA from Oklahoma City or Tulsa?

Under 14 CFR Part 382, airlines at Will Rogers (OKC), Tulsa (TUL) and Lawton (LAW) may treat an ESA as a pet. A task-trained psychiatric service dog keeps service animal status on board.

Where do I file a housing complaint in Oklahoma?

With the Oklahoma Attorney General's Office of Civil Rights Enforcement within one year of the last alleged unlawful housing practice, or with HUD within one year. A private Fair Housing Act lawsuit can be filed within two years.

Does an evaluation guarantee an ESA letter?

No. A licensed provider decides after evaluating you and may not recommend an ESA.
