Arkansas ESA Laws at a Glance
In Arkansas, keeping an emotional support animal is a housing question, decided as a reasonable-accommodation request under the federal Fair Housing Act and Ark. Code Ann. § 16-123-301 et seq.. Since May 22, 2026, HUD reviews requests for untrained ESAs case by case, so Arkansas's own rules below matter.
Added in 2023 (HB 1420) and modeled on California's AB 468. Section 20-14-1004 targets passing off ESA dogs as service animals and says it doesn't change housing accommodation rights.

Arkansas ESA FAQ
Do I need to register my emotional support animal in Arkansas?
No. Neither federal nor Arkansas law requires or recognizes ESA registration; what counts is documentation that meets Ark. Code Ann. § 20-14-1003.
What does Arkansas require in an ESA letter?
An ESA-dog letter writer must be licensed where the letter is issued, list license details, have a client relationship of at least 30 days (homeless exception), do a clinical evaluation, and renew the letter yearly. (Ark. Code Ann. § 20-14-1003).
Can my landlord in Arkansas refuse my ESA or charge a pet fee?
The landlord must consider it as a reasonable-accommodation request under Ark. Code Ann. § 16-123-301 et seq. and the federal Fair Housing Act. Since May 2026, HUD no longer treats untrained ESAs as presumptively reasonable, so the outcome depends on your facts and Arkansas law. If it's granted, ask in writing whether pet fees or deposits are waived.
Is it illegal to misrepresent an emotional support animal in Arkansas?
Yes. Under Ark. Code Ann. § 20-14-1004: Civil penalties of $500, then $1,000, then $2,500 for violating the state's ESA documentation and seller-notice rules.
Can I take my ESA into stores or restaurants in Arkansas?
No. Ark. Code Ann. § 20-14-304 and the ADA give access rights to trained service dogs only.
Can I fly with my ESA from Little Rock (LIT)?
Airlines at Little Rock (LIT) may treat an ESA as a pet under 14 CFR Part 382, so check your airline's pet rules before booking.
Where can I file a housing complaint in Arkansas?
With the Arkansas Fair Housing Commission (Dept. of Inspector General) within 1 year of the incident, or with HUD within 1 year. Private Fair Housing Act lawsuits can be filed within 2 years.
