Kentucky ESA Laws at a Glance

In Kentucky, keeping an emotional support animal is a housing question, decided as a reasonable-accommodation request under the federal Fair Housing Act and KRS 383.085. Since May 22, 2026, HUD reviews requests for untrained ESAs case by case, so Kentucky's own rules below matter.

Kentucky ESA FAQ

Do I need to register my emotional support animal in Kentucky?

No. Neither federal nor Kentucky law requires or recognizes ESA registration; what counts is documentation that meets KRS 383.085(1)(b).

What does Kentucky require in an ESA letter?

Documentation must come from a provider in a good-faith therapeutic relationship who holds an unrestricted KY license and practices in-state (new residents: prior-state provider). Fee-for-letter providers excluded. (KRS 383.085(1)(b)).

Can my landlord in Kentucky refuse my ESA or charge a pet fee?

The landlord must consider it as a reasonable-accommodation request under KRS 383.085 and the federal Fair Housing Act. Since May 2026, HUD no longer treats untrained ESAs as presumptively reasonable, so the outcome depends on your facts and Kentucky law. If it's granted, ask in writing whether pet fees or deposits are waived.

Is it illegal to misrepresent an emotional support animal in Kentucky?

Yes. Under KRS 383.085(6)-(7): Violation, fine up to $1,000, for misrepresenting need, false documents, or fee-driven letters.

Can I fly with my ESA from Louisville (SDF)?

Airlines at Louisville (SDF) may treat an ESA as a pet under 14 CFR Part 382, so check your airline's pet rules before booking.
