Colorado ESA Laws at a Glance
In Colorado, keeping an emotional support animal is a housing question, decided as a reasonable-accommodation request under the federal Fair Housing Act and C.R.S. § 24-34-502. Since May 22, 2026, HUD reviews requests for untrained ESAs case by case, so Colorado's own rules below matter.
A written finding from a professional under these sections is an affirmative defense to the misrepresentation charge. Lacking one does not by itself prove misrepresentation.

Colorado ESA FAQ
Do I need to register my emotional support animal in Colorado?
No. Neither federal nor Colorado law requires or recognizes ESA registration; what counts is documentation that meets C.R.S. § 12-245-229 (also §§ 12-240-144, 12-255-133).
What does Colorado require in an ESA letter?
A licensed mental health professional, physician, or nurse asked for a housing assistance-animal finding must have met the patient in person, know the patient and condition well enough, and be qualified to judge. (C.R.S. § 12-245-229 (also §§ 12-240-144, 12-255-133)).
Can my landlord in Colorado refuse my ESA or charge a pet fee?
The landlord must consider it as a reasonable-accommodation request under C.R.S. § 24-34-502 and the federal Fair Housing Act. Since May 2026, HUD no longer treats untrained ESAs as presumptively reasonable, so the outcome depends on your facts and Colorado law. If it's granted, ask in writing whether pet fees or deposits are waived.
Is it illegal to misrepresent an emotional support animal in Colorado?
Yes. Under C.R.S. § 18-13-107.3: Civil infraction (needs a prior warning): $25 first, $50–$200 second, $100–$500 third or later.
Can I take my ESA into stores or restaurants in Colorado?
No. Colo. Rev. Stat. § 24-34-803 and the ADA give access rights to trained service dogs only.
Can I fly with my ESA from Denver (DEN)?
Airlines at Denver (DEN) may treat an ESA as a pet under 14 CFR Part 382, so check your airline's pet rules before booking.
Where can I file a housing complaint in Colorado?
With the Colorado Civil Rights Division within 1 year of the incident, or with HUD within 1 year. Private Fair Housing Act lawsuits can be filed within 2 years.
